I . <br />ADMINISTRATIVE ORDER NO. 58-97-18 <br />. of the <br />AIltPORT MANAGER <br />CONCERNING NOTICE OF PROPOSED REVISION OF AIRPORT FEE <br />SCHEDULE BY DELETING NON-COMMERCIAL AND COMI~~RCIAT. <br />LAND RENTAL RATES AND THE OLD TOWER BUILDING LEASE RATE. <br />The Airport Manager of the City of Eugene finds,as follows: <br />A. Authority is granted to the City Manager of the City of Eugene under Sections 2.440 <br />to 2.442 of the Eugene Code, 1971 to set fees and charges for the use of the Eugene Airport. The <br />City Manager has further delegated that authority to the Airport Manager under Airport Rule 8.4.2. <br />B. Pursuant to that delegated authority Administrative Order No. 58-97-10-F was issued <br />on June 30, 1997 revising and ratifying the Airport Fee Schedule attached as Exhibit A thereto, <br />effective July 1, 1997. The non-commercial and commercial land rental rates and the Old Tower <br />Building lease fee are set forth in Sections 10 and 11 of that Fee Schedule. <br />C. Subsection (1)(a) of Section 2.440 of the Eugene Code, 1971 exempts from the <br />ratemaking procedures those fees, rents or charges provided for by a lease, contract or permit with <br />the City. All users of the Old Tower Building and non-commercial and commercial land at the <br />Airport now do so under written agreements with the City, and Sections 10 and 11 of the Airport Fee <br />Schedule should therefore be deleted and Sections 12 and 13 renumbered 10 and 11, as set forth in <br />the Notice of Intended Amendment of the Airport Fee Schedule attached as Exhibit A hereto and <br />incorporated herein by reference. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, persons who have <br />requested notice, persons currently paying such charges, posted at two locations at the Airport, <br />published in the Register Guard, a newspaper of general circulation within the City and be made <br />available for interested persons at the offices of the Airport Manager, 28855 Lockheed Drive, <br />Eugene, Oregon 97402 during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br />Friday, exclusive of holidays). <br />2. All persons desiring to comment thereon shall submit written comments as set forth <br />in the Notice.
