_:_ Section 2: <br />Z.A GENERAL <br />PERMITS FOR WORK WITHIN THE PUBLIC WAY. <br />No person or municipal utility shall perform work affecting the public way without first <br />obtaining a permit from the City Engineer. EC 7.290(2) <br />As used herein, "work affecting the public way" includes, but is not limited to, installation, <br />or construction of any structure, pipe, conduit, culvert, or facility, including a <br />communications facility or other wire line facility in the public way, and any construction,. <br />reconstruction, grading, dust control, repair, opening or excavation of a public wary for any <br />purpose but does not include. the construction of public improvements performed under a <br />contract executed. by the City Manager or work performed by City employees under the <br />City Manager's direction. EC 7.290(1).. <br />Issuance of a permit for work within the public way does not relieve the permittee lromahe <br />responsibility to obtain other necessary permits and to conform to other regulatory. <br />requirements. lri certain areas of the public way, location restrictions, setbacks; natural <br />resource preservation, wetland, or other local, state, or federal regulations may.apply. For <br />example, a separate erosion prevention permit may be required, in addition to a right-of- <br />-way cut permit, for work performed in the public way. EC 6.635(1)- <br />While no# required by the Eugene Code, an adop#ed Ci#y of Eugene policy requires work <br />within the public way which is to be performed under a contract executed by .the City. <br />Manager to be reviewed by Public Works staff and a permit to be issued. All associated <br />fees shall be waived. <br />An individual right-of--way use permi# is required, unless otherwise specified in a ,current <br />annual blanket permit, for an activity which affects the public way and meets an bf the <br />following conditions: <br />1. - The activity involves the removal and replacement of any City=owned, facilities (e.g. <br />street pavement, trees, concrete curbs or sidewalks). <br />2 <br />3 <br />4 <br />The activity involves the relocation of the existing facility (e.g_ changing the foot line <br />or elevation of underground facilities or moving existing poles or guy lines to a new <br />location). <br />The activity involves the cutting of any root 2 inches in diameter or greater of a <br />street tree within the critical root zone of the street tree. <br />The activity involves installing more than 100 linear feet of pipe, conduit or .cable. <br />5_ The activity includes closing a lane of traffic on an arterial street or any street within <br />the downtown core area. <br />6 12/01 /97 <br />Utility & R/W Permit Policy <br />
