TEMPORARY WAIVER OF A PORTION OF PARK RULE <br />1.025 AT ALTON BAKER PARK ON JULY 4, 2001, FOR <br />PURPOSES OF ALLOWING A FIREWORKS DISPLAY. <br />The Director of the Public Works Department of the City of Eugene finds that: <br />A. Section 4.680(2) of the Eugene Code, 1971, prohibits persons from being in a park <br />between the hours of 11:00 p.m. and 6:00 a.m. unless exempt by motion of the City Council based <br />on a finding that the exemption is in the public interest. <br />B. Section 1.003(1) of Administrative Order No. 58-98-16-F, adopted on October 29, <br />1998 (the "Park Rules") incorporates the prohibition set forth in Section 4.680(2) of the Eugene <br />Code, 1971. Section 1.025(4) of the Park Rules prohibits the use of all types of fireworks in park <br />areas. <br />C. The Eugene Active 20/30 Club, by and through their Freedom Festival Chair, John <br />Lawrence, has requested a temporary waiver of those rules at Alton Baker Park for the purpose of <br />conducting therein a July 4, 2001 fireworks display (the "Special Fireworks Event"). <br />/ D. On Apri123, 2001, the City Council, finding that holding the Special Fireworks Event <br />at Alton Baker Park was in the public interest and consistent with council goals and policies, <br />exempted the Special Fireworks Event from the prohibitions of Section 4.680(2) of the Eugene <br />Code, 1971. <br />E. Section 1.072 of the Park Rules provides that the Executive Director may, by <br />administrative order, temporarily waive any of the requirements of the Park Rules upon finding that <br />such waiver is in the public interest and will not seriously prejudice or infringe upon the use and <br />enjoyment of a park or park facility by others. <br />F. Waiver of applicable provisions of the Park Rules as provided below to permit the <br />Special Fireworks Event at Alton Baker Park is in the public interest and will not seriously prejudice <br />or infringe upon the use and enjoyment of Alton Baker Park by others. <br />Now, therefore, based on the above findings, which are hereby adopted, <br />I hereby Order that: <br />1. A temporary waiver of Section 1.025(4) of the Park Rules is granted to allow the <br />Special Fireworks Event to be conducted at Alton Baker Park on July 4, 2001, subject to the <br />following conditions: <br />_ _, <br />;~ <br />;. <br />`~ ~.-- -' Administrative Order - 1 <br />C:\WINDOWS\TEMP101FireworksWaiver.wpd .. <br />
