ADMINISTRATIVE ORDER NO. 21-OS-06 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF THE <br />PUBLIC RECORDS REQUESTS FEE SCHEDULE; REPEAL OF <br />ADMINISTRATIVE ORDER NO. 21-04-02-F; AND REPEAL OF THE <br />PROVISIONS OF ADMINISTRATIVE ORDER NOS. 44-92-05, 53-04-O1-F, <br />AND 57-02-08-F THAT ARE IN CONFLICT THEREWITH. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City .for services, goods, use of <br />municipal property, and licenses and permits. In accordance with those provisions, <br />Administrative Order No. 21-04-02-F was issued on February 2, 2004, adopting an amended <br />Public Records Fee Schedule. <br />B. In accordance with the above procedures, I intend to amend the Public Records <br />Requests Fee Schedule by revising the calculation criteria for Research, File Review Staffing, <br />and Computer Program Work; adding and amending fees for Police Reports and Fire Reports; <br />adding fees for DVDs, faxes, e-mails; adding information regarding payment of charges; and <br />reorganizing the schedule. The proposed amendments ar-e set forth in the Notice of Intended <br />Amendment of Fees attached as Exhibit A. The amendments are necessary to more accurately <br />recapture the costs of staff time involved in responding to public records requests and to add <br />charges for new services being provided. The fees for Police Reports and Fire Reports are being <br />proposed to be set at a rate higher than copy charges in other departments due to the fact that the <br />Police and Fire Reports must first be copied, the copy redacted of confidential information, and <br />the redacted copy then re-copied for the requester. Iri addition, the charge for those Reports also <br />includes the basic research charge. <br />C. In determining the proposed fees, I have considered the applicable policies, <br />enactments and directives of the City Council, provisions of state law related to public records, <br />the costs of providing the services supported by the fees, the amounts charged by other <br />comparable providers, and the revenue needs of the City as determined by the adapted City <br />budget. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice attached as Exhibit A be provided to the Mayor and City <br />Councilors, posted at two locations at -City Hall, and be made available for inspection by <br />interested persons at the office of the City Manager,, 777 Pearl Street, Eugene, Oregon 97401, <br />during normal business hours (8:00 a.m. to 5:00 p.xn., Monday through Friday, exclusive of <br />holidays). <br />Administrative Order -Page 1 <br />
