NOTICE OF INTENDED ADOPTION OF A <br />REAL PROPERTY PURCHASE APPLICATION FEE. <br />To: The Mayor and City Councilors of the City of Eugene, and other interested persons. <br />NOTICE IS HEREBY GIVEN that pursuant to the provisions of Sections 2.020 and <br />2.860 through 2.874 of the Eugene, Code, 1971, the City Manager of the City of Eugene intends <br />to adopt the following fee for processing an application for the purchase of City-owned.... <br />properties that have been declared to be surplus at the request of a prospective purchaser of such <br />property: <br />Application Fee ..................................................................................................................$1,000.00 <br />If the prospective purchaser requesting a declaration of .property as surplus and sale of such <br />property is successful and completes the purchase of the property, the application fee will be <br />credited toward the purchase price. Failure to complete the purchase will result in forfeiture of <br />the application fee unless another bidder completes the purchase, in which case the application <br />fee is returned to the person submitting the fee and the fee is not credited to the purchase price. <br />The above fee is necessary in order to comply with .applicable policies and directives of <br />the City Council to recover the cost of services from the direct beneficiaries of those services; <br />and is necessary in the order to defray the City's costs associated with providing those services. <br />The proposed fee is sufficient to cover the City's costs associated with the declaration of the <br />property as surplus, the cost of advertising the sale of such property, the cost of appraising such <br />property, and the preparation of associated bid packet materials for the sale of such °surplus <br />property. As indicated above, the application. fee will be credited toward the purchase where the <br />application fee is paid by the successful bidder; forfeited if that successful bidder fails to <br />complete the purchase, unless another bidder completes the .purchase, in which case the <br />application fee is returned to the first bidder and not credited to the purchase price. <br />Persons desiring to comment hereon shall submit written comments to the Public Works <br />Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. <br />to 5:00 p.m. Monday through Friday, exclusive of holidays), within 15 days of the date of <br />publication and posting as indicated below. The City Manager will consider the comments <br />received and by administrative order establish the fees as proposed or as modified in response to <br />the comments, after the expiration of the period for comment. <br />Dennis M.
