ADMINISTRATIVE ORDER NO. 58-OS-12 <br />of the <br />City Manager <br />City of Eugene, Oregon <br />RE-DELEGATING SNOW-EMERGENCY RELATED DUTIES TO THE <br />MAINTENANCE DIVISION MANAGER OF THE PUBLIC WORKS <br />DEPARTMENT, AND REPEALING ADMINISTRATIVE ORDER NO. 58- <br />91-12. <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, <br />the City Manager is designated as the administrative head of the City, and is specifically <br />authorized to appoint and remove all employees (except as otherwise provided in the' Charter), <br />assign duties to administrative employees, and to enforce all ordinances of the City. <br />B. Pursuant to that authority, on December 20, 1991 the City Manager issued <br />Administrative Order No. 58-91-12 delegating to the Maintenance Division Manager of the <br />Public Works Department the authority to perform and carry out the snow emergency related <br />duties a nd r esponsibilities o f t he C ity M anager as s et f orth i n S ections 5.677 t o 5.687 o f t he <br />Eugene Code, 1971, and in accordance with the policies established by the City Council. in <br />Resolution No. 4278 adopted on October 30, 1991 `and amended by Resolution No. 4784 on <br />January 12, 2004. <br />C. On February 28, 2005 the City Council adopted Resolution No. 4826, establishing <br />revised policies for ice and snow control, and repealed Resolution Nos. 4278 and 4784. It <br />continues to be in the public interest to have the City Manager's snow emergency related duties <br />performed by the Maintenance Division Manager of the Public Works Department. In order to <br />avoid any potential confusion as to that authority, Administrative Order No. 58-91-12 should be <br />repealed, and authority re-delegated as provided herein. <br />NOW, THEREFORE, <br />THE CITY MANAGER OF THE CITY OF EUGENE ORDERS AND DIRECTS <br />THAT: <br />1. Based on the above findings, which are adopted herein, the Maintenance Division <br />Manager of the Public Works Department of the City of Eugene as my designee, is hereby <br />authorized to: <br />1.1 Perform and carry out the duties and responsibilities of the City Manager <br />set forth in Sections 5.677 to 5.687 of the Eugene Code, 1971; in accordance with the <br />policies established by Resolution of the City Council, including the authority to: <br />Administrative Order 1 <br />
