ADMINISTRATIVE ORDER NO. 58-05-03 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT TO <br />THE STORMWATER USER FEES AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 58-04-13-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section C of Ordinance No. 19984 adopted by the Council and approved by <br />the Mayor on September 28, 1994 provides that adjustments to the monthly stormwater <br />customer c harges b e effected by the City Manager pursuant to Section 6.411 of the <br />Eugene Code, 1971 (EC), which authorizes the City Manager to determine and set fees <br />and charges to be imposed by the City for wastewater service, regional wastewater service, <br />and stormwater service. <br />B. Pursuant to EC Section 6.411, I have investigated the City's current revenue <br />needs and cost of operation of the City's stormwater service system. I propose to increase <br />the user fees for stormwater service, which were established by Administrative Order No. <br />58-04-13-F on June 16, 2004 and became effective on July 1, 2004. The proposed <br />increases are set forth in Exhibit A attached hereto. The proposed increases are <br />necessary in order to comply with the Council's directive that the costs of providing such <br />services be recovered from the beneficiaries of the services, and other applicable policies <br />and directives of the City Council; are consistent with applicable federal and state <br />regulations; are comparable to the amounts charged by the City of Springfield and other <br />such service providers for comparable services; preserve the equity between different <br />classes of ratepayers; and are based on the proposed budget of the City. <br />C. Based on that investigation, I intend to increase the stormwater user fees for <br />stormwater service as set forth in the Notice of Intended Increases in stormwater Service <br />Charges attached as Exhibit A hereto, effective for all bills issued on or after July 1, 2005. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, the news <br />media, any person who has requested notice, to interested governmental agencies <br />(including the United States Environmental Protection Agency, the Department of <br />Environmental Quality, the Metropolitan Wastewater Management Commission, and the <br />Eugene Water & Electric Board), posted at two locations at City Hall, published on two <br />separate occasions in the Register Guard, a newspaper of general circulation within the <br />City, and be made available for inspection by interested persons at the offices of the Public <br />Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business <br />hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). <br />Administrative Order -Page 1 <br />
