DRAFT 2010-2013 STATEWIDE TRANSPORTATION IMPROVEMENT PROGRAM <br />means that money is written into the federal <br />budget for one and only one purpose. Ear- <br />marks often involve large modernization <br />projects, but Oregon and other states have <br />secured earmarks for bridge and public tran- <br />sit projects as well. <br />Earmarks usually do not cover all of a pro- <br />ject's cost, and will require matching funds <br />along with additional funds to fully fund the <br />project. ODOT coordinates with the Oregon <br />Congressional Delegation on a set of ear- <br />mark priorities for which the state will <br />pledge its resources as matching funds, to be <br />submitted for consideration during the fed- <br />eral budget process. <br />PUBLIC INVOL VEMENT AND <br />GOVERNMENT INVOLVEMENT <br />There are federal regulations and state poli- <br />cies regarding STIP public involvement. The <br />federal regulations state that public in- <br />volvement must be proactive, must provide <br />opportunities for early and ongoing in- <br />volvement, and must continue throughout <br />the transportation planning and program- <br />ming process. The state must comply with <br />the requirements set out in Title VI of the <br />federal Civil Rights Act, and the Executive <br />Order pertaining to Environmental Justice. <br />They further stipulate that the state provide: <br />• A process for demonstrating explicit <br />consideration and response to public in- <br />put during the planning and program de- <br />velopmentprocess; and <br />• A process for seeking out and consider- <br />ing the needs of those traditionally un- <br />derserved by existing transportation sys- <br />tems, such as low-income and minority <br />households, which may face challenges <br />accessing employment and other ameni- <br />ties. <br />ODOT's Public Involvement Policies and <br />Procedures document (December 1994) is <br />more prescriptive and inclusive, stating: <br />• The Department will provide a 45-day <br />public review period for the draft STIP, <br />and a 45-day public review period for <br />any major revision of the approved <br />STIP; <br />• The Department will provide statewide <br />opportunities for public comment on the <br />draft STIP by scheduling at least two <br />public meetings in each of ODOT's five <br />regions prior to adoption of the program <br />by the OTC; and <br />• The Department will consider all public <br />comments on the draft STIP prior to <br />adoption of the program by the OTC. <br />Public review comments are welcome at any <br />time through the ODOT website: <br />http://www. ore~on. Gov/ODOT/HWY/STIP/. <br />Local Governments <br />Federal rules for planning include several <br />specific requirements. ODOT meets many <br />of these requirements through the ACT <br />process as well as other advisory committees <br />described below. Federal agencies, tribal <br />governments, and local officials, including <br />MPO representatives, are members of the <br />ACT in their area. In areas without ACTS, <br />the ODOT region staff works with the <br />MPOs and other bodies such as the County <br />Commission or Coordinating Committee to <br />develop the region STIP program. <br />Federal requirements for Metropolitan and <br />Statewide Planning in Chapter 23 of the <br />Code of Federal Regulations (23 CFR <br />1410.216(b)) state that: <br />(1) MPOs shall be involved on a cooperation <br />basis for parts of the STIP affecting metro- <br />politanplanning areas; <br />Page 26 <br />
