Civil rightsluse of force claims are also one of the most common type of claim filed against the Department. <br />In FY05, six claims were filed; in FY06 four claims were filed and in FY07 6 claims were filed alleging civil rights <br />violations (false arrest, use of force). For FY07, two of these claims were closed without payment and four <br />claims remain open however, we do not anticipate payments on any of those claims. <br />--~__ ~ Litigation <br />~' Over the past five years, 27 lawsuits were filed against the Eugene Police Department. To date, <br />~~i`--.~-~ only four lawsuits remain active. We anticipate that two cases resulting from the <br />- service of a warrant in the Whiteaker area will be resolved this year. Two other cases <br />have pending appeals, one involving allegations of racial discrimination and the <br />other alleging the false arrest of a disorderly subject after she was trespassed from <br />4 her ex-boyfriend's home. No lawsuits have been filed in FY06 or FY07 to date. <br />~1 <br />,.~,. <br />WORKERS' COMPENSATION CLAIMS , <br />The number of claims filed by Police employees rose from 55 in FY06 to 72 in l~s~k>_ <br />FY07 which is the highest number of claims in the last five fiscal years. There - <br />was also an increase in the number of disabling claims to 13 which represents ,-_ <br />18% of the total claims. (A claim is disabling when an employee misses more <br />than three days of work or the injury results in impairment.) In FY07 the total <br />claims cost for Police rose by 35% to $309,869 which is also the highest total in <br />the last five fiscal years.
