State and Federal Mandates <br />There are several federal and state laws and regula- <br />tions pertaining to transportation that have some <br />relationship to the city's Arterial and Collector Street <br />Plan. While some of these regulations are addressed <br />at least in part by inclusion in this document, others <br />have been, or will be satisfied through other <br />adopted plans, policies, or codes -but are still <br />referenced or acknowledged in the Arterial and <br />Collector Street Plan. Following is a listing of the <br />pertinent federal and state requirements. <br />Street Classification <br />Federal transportation legislation known as ISTEA <br />(Intermodal Surface Transportation Efficiency Act), <br />and the state Transportation Planning Rule (TPR), <br />require a functional classification system of streets, <br />roads and highways as a major component of the <br />regional Transportation System Plan, which, for the <br />Eugene-Springfield area is TransPlan. The updated <br />TransPlan, when adopted, should incorporate as part <br />of that regional street and roadway network, the City <br />of Eugene's adopted street classification system. <br />Americans with .Disabilities Act (ADA) <br />Provision of Facilities for <br />Bicycles & Pedestrians <br />Both ISTEA and TPR, along with State legislation <br />and administrative rules, require that when major <br />collectors or arterials are constructed or recon- <br />structed, bikeways and sidewalks be provided as <br />part of the street improvements within the right-of- <br />way. The city's adopted Design Standards, along <br />with policies in TransPlan, the Local Street Plan, <br />and language in the city code include essentially <br />these same requirements. The Arterial and Collector <br />Street Plan incorporates, and in some instances <br />strengthens these standards. <br />Under state law, bicyclists are allowed on all <br />streets, and every street must accommodate bicy- <br />clists safely. To ensure the safety of cyclists, both <br />Federal and State legislation require that when <br />major collectors or arterials are constructed or <br />reconstructed, bikeways and sidewalks must be <br />provided as part of the street improvements within <br />the right-of-way. <br />For purposes of this document, "bikeway" is defined <br />as on-street provision for bicycles, including striped <br />This document supports provision of facilities for lanes or shared use of lanes by motor vehicles and <br />people with disabilities, in all street improvement bicycles where traffic characteristics allow such. <br />and construction projects.
