purpose; but does not include the construction of public improvements performed under a contract <br />executed by the City Manager or work performed by City employees under the City Manager's <br />direction. See EC 7.290(1). <br />Issuance of a permit for work within the public way does not relieve the permittee from the <br />responsibility to obtain other necessary permits and to conform to other regulatory requirements. <br />In certain areas of the public way, location restrictions, setbacks, natural resource preservation, <br />wetland, or other local, state, or federal regulations may apply. For example, a separate erosion <br />prevention permit may be required, in addition to aright-of--way cut permit, for work performed in <br />the public way. See EC 6.635(1). If an erosion permit is required, no other permits will be issued <br />prior to the approval of the erosion permit, Administrative Rule R-6.645-F-(5). <br />Individual pernuts that are included in the category of street andright-of--way work permits include, <br />but are not limited to, Right-of--Way Cut Permits, Right-of--Way Use Pernuts, UtilityRight-of--Way <br />Use Permits, Tree Removal Permits, Traffic Control Permits, and Temporary Surfacing Permits. <br />Work within the public way that is to be performed under a contract executed by the City Manager <br />must be reviewed by Public Works staff and a permit must be issued to the Department managing <br />the contract. All associated fees shall be waived. <br />An individual right-of--way use permit is required, unless otherwise specified in a current annual <br />blanket permit, for an activity which affects the public way and meets a-X of the following <br />conditions: <br />1. The activity involves the removal, modification, or replacement of any City-owned facilities <br />(e.g. street pavement, trees, concrete curbs, sidewalks, or bike path). <br />2. The activity involves the relocation or modification of the existing facility (e.g. changing the <br />foot line or elevation of underground facilities or moving existing poles or guy lines to a new <br />location). <br />3. The activity involves the cutting of any root 2 inches in diameter or greater of a street tree, <br />or the cutting of a branch 2 inches in diameter or greater of any street tree. <br />4. The activity involves installing more than 1001inear feet of pipe, conduit or cable. <br />5. The activity includes closing a lane of traffic on an arterial or collector street, or any street <br />within the downtown core area. <br />6.
