ADMINISTRATIVE ORDER N0.58-04-04 <br />' , of the <br />` ~ City Manager of the City of Eugene <br />CONCERNING NOTICE OF, INTENDED INFLATIONARY <br />ADJUSTMENT OF SYSTEMS DEVELOPMENT CHARGES <br />FOR LOCAL WASTEWATER SYSTEM, STORMWATER <br />SYSTEM, AND TRANSPORTATION SYSTEM. <br />The. City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager of the City of <br />Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. Eugene Code 7.710(5) authorizes the City Manager <br />to adopt by administrative order changes to SDC rate factors and cost indices. <br />B. The SDC Methodologies were adopted by Resolution No. 4740 on September 23, <br />2002, and subsequently amended by Resolution Nos. 4748, 4767, 4768, 4770 and 4776. <br />C. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the <br />Eugene Code, 1971, I propose to amend portions. of the Systems Development Charges by <br />implementing a 5.0% inflationary increase to. both the local wastewater system and transportation <br />system, and a 4.3 % inflationary increase to the stonmwater system, asset forth in the Notice attached <br />as Exhibit A. These inflationary adjustments are based onthe nationa120-city average Construction <br />Cost Index as published by the Engineering News-Record. <br />D. I find that the proposed inflationary adjustments to the Systems Development Charges <br />set'forth in Exhibit A are consistent with adopted policies of the City, inconformity with applicable <br />state law, authorized by EC 7.710(5), and should be implemented effective Apri15, 2004. Upon <br />adoption, the final Administrative Order and amended fees shall be appended to the Systems <br />Development Charge Methodologies. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice of the proposed inflationary adjustment be provided to the <br />Mayor and City Councilors and to persons who have requested such notice, posted at two locations <br />at City Hall, published in the Register-Guard, a newspaper of general circulation within the City, and <br />be made available for inspection by interested persons at the office of the City Engineer, Public <br />Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 <br />a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />Administrative Order - 1 <br />
