<br />ADMINISTRATIVE ORDER N0.58-04-04-F <br />of the...,.. <br />City Manager of the City of Eugene <br />INFLATIONARY ADJUSTMENT OF SYSTEMS <br />DEVELOPMENT CHARGES FOR LOCAL. WASTEWATER <br />SYSTEM, STORM WATER SYSTEM, AND <br />TRANSPORTATION SYSTEM. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager of the City of <br />Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. Eugene Code 7.710(5) authorizes the City Manager <br />to adopt by administrative order changes to SDC rate factors and cost indices. <br />B. The SDC Methodologies were adopted by Resolution No. 4740 on September 23, <br />2002, and subsequently amended by Resolution Nos. 4748, 4767, 4768, 4770 and 4776. <br />C. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the <br />Eugene Code,1971, on March 2, 2004, I issued Administrative Order No. 58-04-04 and notified the <br />Mayor and City Council that I intended to amend portions of the Systems Development Charges <br />based on the national 20-city average Construction Cost Index as published by the Engineering <br />News-Record, by implementing a 5.0% inflationary increase to both the local wastewater system and <br />transportation system, and a 4.3% inflationary increase to the stormwater system, as set forth in the <br />Notice attached as Exhibit A thereto. <br />D. Notice was also posted at two locations at City Hall on March 5, 2004, published in <br />the Register-Guard, a newspaper of general circulation within the City, on March 7, 2004, and made <br />available for inspection by interested persons at the office of the City Engineer, Public Works <br />Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to <br />5:00 p.m., Monday through Friday, exclusive of holidays). Notice provided that written comments <br />would be received for a period of 15 days from the date of publication. No comments were received <br />within the time or in the manner set forth in the Notice. <br />E. I find that the Systems Development Charges should be amended as proposed and that <br />the rates set forth in Exhibit A attached hereto are consistent with adopted policies of the City, in <br />conformity with applicable state law, authorized by EC 7.710(5), and should be implemented <br />effective April 5, 2004. <br />Administrative Order - 1 <br />
