The flying club shall indemnify and. hold the City of Eugene <br />and its officers, agents and employees, harmless from and <br />against alT claims, actions, liabilities, costs, including costs <br />of defense, arising out of or in any way related to the club's <br />activities at the Airport, the club's failure to comply strictly <br />with any provision of these rules or of ,the club's lease or <br />permit with the City, or of any other actions or failure to act <br />by the-club and the club's members, agents, officers and <br />contractors. In the event any such action or claim is brought <br />against the City, the club shall, if the City so elects and <br />.upon tender by the Gity; defend the same at the club's sole <br />expense and cost, promptly satisfy any judgment adverse to the <br />City or to City and club jointly, and reimburse the City for <br />any loss, cost, damage or expense suffered or incurred by the • <br />City, including any legal fees, or fines paid to the FAA or <br />any other governmental agency arising from the club's activities. <br />H. In order to be recognized as a flying club at the Mahlon Sweet - <br />Airport, the club must certify in writing that it will comply <br />at ail times with the rules and regulations established for <br />flying clubs by the Mahlon Sweet. Airport. <br />I. After receiving notification of a deficiency from the Airport <br />Manager, the flying club will have thirty (30j days to take <br />the corrective action needed to cure the. deficiency. If corrective <br />actions are not taken within that thirty (30) day period; or if <br />any second deficiency occurs within a twelve-month period-following <br />a notification of deficiency, the Airport Manager will begin <br />revocation procedures. <br />J. Upon determining that aground for revocation of the flying club's <br />permit exists, the Airport Manager shall provide written notice of. <br />rev.ocation'to the operator which shall be effective after 15 days. <br />However; if continuance of the flying club affords an immediate <br />risk to the public health., welfare, or safety, or interferes with <br />another permitted activity at the Airport, the revocation shall be <br />effective when issued.' • <br /> <br />Appendix A - iv <br />
