Flying Club Rules <br />All flying clubs desiring to base their aircraft anal operate on the Airport <br />must comply with the applicable provisions of the Rules and Regulations of the <br />Mahlon Sweet Airport. Since flying clubs are NOT commercial aeronautical <br />activities serving the public, they shall be exempt from the minimum standards <br />for FBO's providing aeronautical services to the public upon satisfactory <br />fulfillment of the conditions contained herein. <br />A. Organizational Structure <br />The club shall be an entity (corporation, association, or partner- <br />. ship) that is not-for-profit and is organized for the express <br />purpose of providing its members with one or more aircraft for <br />their .personal use and enjoyment only.* Each member must be <br />a bona fide owner of the aircraft or stockholder in the corpora- <br />tion. The aircraft access rights of all the members of the <br />club shall be equal and no. part of the net earnings of the :club <br />will inure to the benefit of any member in any form (salaries, <br />bonuses, etc.).. The club may not derive greater revenue from. <br />the operations, maintenance and replacement of its aircraft <br />including avionics/aircraft upgrades as well as acquisitions, <br />and engine reserves. <br />B. Authorized Activities <br />Flying clubs may not offer or conduct commercial operations <br />including, but not limited to, charter, air taxi, or rental <br />,.. <br />of aircraft operations. They may not conduct aircraft <br />flight. instruction except for regular members and provided <br />such instruction is offered by a registered member qualified <br />as a flight instructor as set forth in Section 7.7 or 7.8 of <br />these Minimum Standards. Only members of-the flying club may <br />operate the aircraft. No flying club shall permit its aircraft to <br />be utilized for the giving of flight instruction to any person, <br />including members of the club owning the aircraft, when such <br />..person .pays or becomes obligated to pay for such instruction, <br />except when instruction is contracted for from a flight <br />instructor who is authorized by the Airport Manager to do <br />NOTE: For purposes of this definition, the Airport Manager. does <br />not require a club to be organized to meet."non-profit" <br />standards established by the internal Revenue Service. <br />Appendix A - ii <br />
