`. <br />_ '~ <br />ability to .provide responsible, safe, and adequate service to the <br />public. <br />9.1.3 A written listing of the. assets owned, leased, or being <br />purchased which will be used in the business on the airport. Copies of <br />any leases or purchase contracts must be attached. <br />9.1.4 A written agreement that the applicant will execute such <br />forms, releases, or discharges as may be requested by the FAA and all <br />aviation or aeronautic commissions, administrators, or departments of <br />all states in which the applicant has engaged in aviation business, to <br />release- information in their files relating to the applicant or its <br />operation. <br />9.'1.5 The request shall be signed and submitted by the owner <br />of the business if a sole proprietorship, every partner if a partner- <br />ship, and the President. or CE0 if a corporation. <br />9.1.6 The applicant agrees to provide any additional information <br />and material necessary, or requested by the Airport Manager, to <br />establish .to the satisfact-ion of the Airport Manager that the applicant. <br />can qualify and will comply with these minimum standards. <br />9:1.7 If 'd:irected by the applicant, the Airport Manager shall <br />hold the financial information included with the documents separate from <br />the request and not available for public .inspection to the extent <br />covered by the Oregon Public Information Act. <br />9.2 fem. The request shall be accompanied by a fee~set by the Airport. <br />Manager under. Sections 2.440 to 2.442 of the Eugene Code, effective December, <br />1993 as they exist now or may hereafter be amended. <br />9:3` Review of Request`. A request shall be allowed or denied within 45 <br />days after. receipt of:a all ~,of :the required documents. ~ The request may be <br />approved if: <br />9.3.1 The requested operation is consistent with -the Airport <br />Master Plan, ;the Eugene-Springfield Metropolitan Area General Plan,-and <br />relevant provisions ~f federal, state and local laws and rules; and <br />9.3.2. The requested operation would enhance the health, welfare <br />and safety of users ofa-the Airport. <br />In reviewing a request, the Airport Manager may consider whether: <br />9.3.3 `The applicant's past or present violation of laws or <br />regulations presents a reasonable doubt about the applicant's ability <br />to conduct activities at the Airport without endangering property or the <br />.public's health or afety; <br />'9.3..4 the applicant possesses. insufficient skill or expertise <br />to conduct the desired activity; <br />Rules - 37 <br />
