J B - 9S-o Z- <br />' of the. <br />City Manager of the City~of Eugene <br />PROPOSED ADMINISTRATIVE RULE R-6.451 ADOPTING <br />AMENDMENTS TO THE STORMWATER SERVICE METHODOLOGY. <br />i <br />The City Manager of the City of Eugene finds that: <br />~A. On November 17; 1993 the- City Council adopted Ordinance No. 19939 <br />regarding wastewater and stormwater systems and adopting the stormwater Service Charge <br />Methodology Paper ("Methodology"). That Ordinance; and Section 6.451 of the Eugene <br />Code, 1971 as adopted therein, provided that the future modifications of the Methodology <br />would be effected by the City Manager: <br />B. Subsequently, on September 28, 1994, Ordinance No. 19984 was passed by the <br />City Council .and approved by the Mayor adopting changes to the `monthly stormwater <br />customer charges, separating. out components rel,~ted to roads, <br />C. As amended by Ordinance No. 19984, the``monthly stormwater customer <br />charge is now composed of (1) a water quality and quantity component; (2) an <br />administrative component; and (3) a road component. It was intended that reductions and <br />exemptions continue to be available for water quality and quantity components for property, <br />but not for the road component. <br />D. The rate ,methodology set forth in Exhibit A to Ordinance No. 19984, which <br />provides for complete reductions or exemptions, was amended by: ,an Emergency Rule <br />adopted by Administrative Order No. 58-94-27 of the City Manager, .effective November 1, <br />1994 to clarify that the exemption applies to water quality and quantity components, but .not <br />to the road or administrative comporient. <br />E. That Emergency .Rule will expire on April 30, 1995, and the City Manager <br />intends to adopt as a permanent rule proposed changes to the Methodology which clarify <br />that exemptions or reductions provided for therein do not apply to road or administrative <br />components of the stormwater ckia`rges, and to effect minor editorial changes to create <br />consistent usage of terms throughout the Methodology, all as more particularly set forth in <br />Schedule 1 to Exhibit A hereto. These proposed revisions.implement.the action taken by <br />the Council, and stormwater customers will be able to -reduce 'monthly charges for the <br />quantity and quality components of the charge, but no exemptions will be granted for the <br />street-related and administrative components of the charge. <br />F Failure to act promptly in adopting the proposed revisions prior to expiration <br />of the Emergency Rule adopted by Administrative Order No. 58-94-27 will prejudice the <br />Administrative Order - 1 <br />
