<br />n~~x,~~ t~,~. ~- 9P- iz-~ <br />ADMINISTRATIVE ORDER NO. 5&95-10-F <br />of the <br />City Manager of the City of Eugene. <br />AMENDING PLAT CHECKING FEES FOR PARTITIONS; <br />RATIFYING OTHER PLAT CHECKING FEES; AND RESCINDING <br />ADMINISTRATIVE ORDER NO. 53-91-15. <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 9.025 of the Eugene, Code, 1971 authorize the City <br />Manager to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, and licenses and permits. <br />B. In accordance with the procedures set forth herein, on September 19, 1995, <br />I issued Administrative Order 58-95-10, and notified the Mayor and City Councilors that I <br />intended to amend the plat checking fees for partitions set forth in Administrative Order No. <br />53-91-15. A Notice of Intended Increase in Partition Plat Checking Fees was attached as <br />Exhibit A thereto and incorporated .therein by reference. The Notice was also posted at two <br />~ locations at City Hall on September 20, 1995, published in the Register Guard, a newspaper <br />of general circulation within the City, on September 22, 1995, and made available for <br />inspection by interested persons at the office of the City Surveyor, Public Works Engineering <br />'vision 858 Pearl Stree Eu ene Ore on 97401, durin re lar business hours (Monday <br />Di ~ g ~ g g ~ <br />~!, through Friday, exclusive of holidays). <br />'~, <br />. C. The Notice provided that written. comments would be received thereon for a <br />eriod of 15 da s from the first date of ostin and publication. No comments were <br />P g <br />Y <br />P <br />received within the time or in the manner required by the notice. <br />D. I find that the increase in partition plat checking fees set forth in Exhibit A <br />hereto is consistent with applicable policies and directives of the. City Council, including <br />those developed during the Eugene Decisions .process, comparable to the fees established <br />in other jurisdictions for providing such services, in compliance with Section 9.025 of the <br />Eugene Code,. 1971, and is necessary in order to comply with, the Council's goal of <br />recovering the cost of providing the services from the beneficiaries of those services. . <br />E. In addition to partition plat checking fees, Administrative Order No. 53-91-15 <br />also established plat checking fees for subdivisions and .partitions. I further find that it would <br />be more efficient to rescind Administrative Order No. 53-91-15 and combine all the plat <br />checking fees as reflected in Exhibit A attached hereto. <br />On the basis of these findings, I order that: <br />1. Administrative Order No 53-91-15 and any other order in conflict with the <br />i' fees established and/or ratified herein are rescinded as of November 15, 1995. <br />2.
