NOTICE OF INTENDED RULEMAKING <br />OZONE PROTECTION ADMINISTRATIVE RULE R-6.725 <br />NOTICE IS HEREBY GIVEN that pursuant to the authority contained in Sections <br />2.019 and 6.725 of the Eugene Code, 1971, Micheal D. Gleason, City Manager of the City of <br />Eugene, intends to adopt as a permanent rule the Proposed Ozone Protection Administrative <br />Rule R 6.725 as proposed by Administrative Order No. 58-95-11 of the City Manager, which: <br />Sets forth the manner in which the rules are intended. to implement <br />Sections 6.700 to 6.725 of the Eugene Code, 1971, which were adopted by the <br />City Council to reduce the sale anal use of ozone depleting products within the <br />-City; establishes the process for making determinations that products are <br />prohibited ozone-depleting products; provides the effective date of such <br />determinations; establishes procedures for appeals from determinations; sets <br />forth the criteria and methodology for`prohibit~ng ozone-depleting products or <br />~;~. <br />exclusion of products from prohibition; establishes the criteria for designating <br />additional ozone-depleting .chemicals; establishes procedures for processing <br />citizen complaints; and sets forth the procedures for imposition of <br />administrative civil penalties, and the settlement and/or appeal of such penalties. <br />The Proposed Ozone Protection Administrative Rule R-6.725, is necessary for the <br />preservation of the safety and welfare of the public, and in compliance with the City Council's <br />directive as evidenced by Sections 6.700 to 6.725 of the Eugene Code, 1971 adopted by the <br />Council, and may be reviewed at the office of the City Manager,., .City Hall, 777 High Street, <br />Eugene, Oregon 97401 during normal business hours. <br />All persons wishing to comment thereon or object thereto must submit their comments <br />or objections to the Public Works Department,'858 Pearl Street, Eugene, Oregon 97401, in <br />writing, within fifteen (15) days of the'date of the first publication hereof, as indicated below. <br />The City Manager will thereafter adopt the Proposed Ozone_.Protection Administrative Rule <br />R-6.725, as a Permanent Rule. <br />.
