ADMINISTRATIVE ORDER N0.58-99-22 of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF PORTIONS OF <br />THE REDEVELOPMENT FEES AND CREDITS PROVISIONS OF THE <br />CITY OF EUGENE'S SYSTEMS DEVELOPMENT CHARGE (SDC) <br />METHODOLOGY. . <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene Code, 1971 authorize the City Manager of <br />the City of Eugene to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, and licenses and permits, and specifically systems development <br />charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City Manager to adopt <br />and/or amend by administrative order, the methodologies used for establishing the systems <br />development charges, and provides this may be effected concurrent with the establislunent or <br />revision of a systems development charge. <br />B. On November 8, 1999 Ordinance No. 20175, which amended provisions of the <br />Eugene Code, 1971 with respect to the manner in which SDC credits for redevelopment are <br />determined, was adopted by the City Council and approved by the Mayor That ordinance will <br />become effective on December 9, 1999, and the current SDC Methodology should be amended <br />consistent with those revised provisions, and an administrative fee established for reviewing credits <br />for redevelopment projects. <br />C. I therefore intend to amend Sections 1.2, 2.2.1, 7.0 and 7.2.3 of the City of Eugene <br />SDC Methodology with respect to the manner in which administrative charges and credits are <br />computed for redevelopment that constitutes a change of use of a building in its entirety; add a <br />definition of "redevelopment" to Appendix A of the Methodology; and amend the fees for <br />admir~stration in Section 2.6 of Appendix F of the Methodology, as set forth in the Notice of <br />Intended Amendment of Systems Development Charge Methodology, Fees, and Credits attached as <br />Exhibit A, including the attachment thereto, which are incorporated herein by reference. <br />D. I find that the proposed revisions to the SDC Methodology and administrative fee as <br />set forth in Exhibit A and its attachment are consistent with adopted policies of the City, in <br />conformity with applicable state law, and necessary in order to be consistent with recently adopted <br />provisions of the Eugene Code, 197.1. Incompliance with prior direction from the Council and the <br />memorandum submitted at the time the ordinance was considered, the proposed revisions should be <br />implemented retroactively with respect to redevelopment permits in process on and after August 9, <br />1999. <br />On the basis of these findings, I order that: <br />Administrative Order - 1 <br />r:\adminord\fees\99sdccred 1 ao.wpd(11 / 16/99) <br />
