ADMINISTRATIVE ORDER N0.58-99-22-F <br />of the <br />City Manager of the City of Eugene <br />AMENDING PORTIONS OF THE SYSTEMS DEVELOPMENT <br />ARGE (SDC) METHODOLOGY, RATIFYING UNAMENDED PORTIONS <br />THEREOF, AND REPEALING ADMINISTRATIVE <br />ORDER N0.58-99-16-F-2. <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene Code, 1971 authorize the City Manager of <br />the City of Eugene to determine and set fees and charges to be imposed by the City for services, , , <br />goods, use of municipal property, and licenses and permits, and specifically systems development <br />charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City Manager to adopt <br />and/or amend, by administrative order, the methodologies used for establishing .the systems. <br />development charges, and provides this may be effected concurrent with the establishment or' <br />revision of a systems development charge. <br />B. In accordance with the procedures set forth therein, on November 18, 1999, I notified <br />the Mayor and City Councilors that I intended to amend the City of Eugene SDC Methodology <br />previously adopted and/or amended by Administrative Order No. 58-99-16-F-2, by revising portions. <br />of the redevelopment fees and credits provisions of the SDC Methodology. '; <br />C. The Notice was also posted on November 23, 1999 in four public locations and <br />published on November 23, 1999, in the Register Guard, a newspaper of general circulation within <br />the City. In addition, copies of the Proposed Amendments to the Systems Development Charge <br />Methodology were made available for inspection by interested persons at the City Manager's Office, <br />777 Pearl Street, Room 105, the Public Works Building Lobby, 858 Pearl Street, the Permit & <br />Information Center, 99 West 10th Avenue, and the Eugene Public Library, 100 West 13th Avenue, <br />during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of <br />holida~s~. The Notice provided that written comments could be submitted thereon for a period of <br />30 days, through December 23, 1999. No written comments were received. During the comment <br />period staff identified some corrections to typographical errors and other minor cosmetic changes <br />needed to improve clarity and readability which have also been incorporated in Exhibit A hereto. <br />D. Based on the findings and staff recommendations set forth above, I find that the <br />revisions to the Systems Development Charge Methodology, fees, and credits as proposed by <br />Administrative Order 58-99-22 and incorporated in Exhibit A hereto are consistent with adopted <br />policies and ordinances of the City, are in conformity with applicable state law, and necessary in <br />order to be consistent with recently adopted provisions of the Eugene Code, 1971.
