06/01/01 11:36 FAX 541 682 5894 EUGENE CITY HALL X1001 <br />ADI~Il\tIS7['R~.TIVE ORDERS AND RULES <br />The process for developing and implementing administrative orders or rules is prescribed in <br />Sections 2.019 through 2.021 of the Eugene Code. Section 2.019 of the Code empowers the <br />City Manager to adopt Administrative Orders for any provision of the code. Other sections <br />relating to specific programs also delegate the administrative authority. <br />An administrative order may originate from the need to implement provisions of the code; an <br />ordinance passed by the City Council; or to revise and/or update existing orders. Orders may be <br />used to delegate responsibilities, adopt or amend rules, or set fees for City services. <br />Administrative Rules may address topics such as: park rules, parking rules, financial <br />policy, snow routes, System Development Charge (SDC) Fee methodology, etc. <br />Path; Public on `cesrv900'/City Recorder/Index/Reslog2000s.wpd <br />Important Things to Remember <br />• There aze always exceptions. <br />• If the order replaces or amends an existing order, rule or rate, it should reference <br />in the caption. <br />• There are some cases in which the City Manager has delegated his or her authority <br />to develop and sign orders. <br />• The order. or rule must go through the chain of command for approval prior to <br />forwarding for fznal signature. <br />• The order or nil.e must be dated. <br />• A11 original orders should be forwazded to the City Recorder's Office as soon as <br />signed. <br />Nnmberin~S sr <br />All administrative orders must have a number assigned for tracking purposes. <br />Steps to Develop an ,Administrative Order <br />1) Staff should prepare and submit to the City Attorney's Office an outline of the basic <br />information of what is needed in the Administrative Order. <br />t, <br />CROfDOCUMENTS CLASS -5- Proccdures\ord&resclass.ti-'pd <br />
