'.F,e gp, <br />ADMINISTRATIVE ORDER N0.58-01-11-F <br />of the <br />City Manager of the City of Eugene <br />AMENDING PORTIONS OF THE SYSTEMS DEVELOPMENT <br />CHARGE (SDC) METHODOLOGY AND REPEALING ADMINISTRATIVE <br />ORDER N0.58-01-17-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene Code, 1971 authorize the City Manager of <br />the City of Eugene to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, and licenses and permits, and specifically systems development <br />charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City Manager to adopt <br />and/or amend, by administrative order, the methodologies used for establishing the systems <br />development charges, and provides this may be effected concurrent with the establishment or <br />revision of a systems development charge. <br />B. In accordance with the procedures set forth therein, on May 24, 2001, I notified the <br />Mayor and City Councilors that I intended to amend the City of Eugene SDC Methodology by <br />revising the local systems development charge fees with a 2.5% fee increase and adoptirig revised <br />regional Metropolitan Wastewater Management Commission (MWMC) fee and credit rates as <br />calculated by the MWMC. <br />C. The Notice was also posted on May 24, 2001 in four public locations within the City <br />and published on May 27, 2001, in the Register Guard, a newspaper of general circulation within the <br />City. In addition, copies of the Proposed Amendments to the Systems Development Charge <br />Methodology were made available for inspection by interested persons at the City Manager's Office, <br />777 Pearl Street, Room 105, the Human Resource and Risk Services Office, 777 Pearl Street, Room <br />101, and the Public Works Building Lobby, 858 Pearl Street, during normal business hours (8:00 <br />a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). The Notice provided that written <br />comments could be submitted thereon for a period of 30 days, through June 26, 2001. No written <br />comments were received. However, during the comment period staff identified some corrections <br />to typographical errors, and other minor cosmetic changes needed to improve clarity and readability, <br />consisting of: (a) a wording correction on Page 3 to reflect that "Final calculations would be rounded <br />to the nearest cent" instead of "dollar;" (b) inclusion of Page 4 Table 1 Summary of Systems <br />Development Charges, which is a summary of the rates and was not included in the preliminary <br />Administrative Order; (c) inclusion of Page C-6 Figure 4 Local Wastewater System, which is a <br />summary of the local wastewater rates and was not included in the preliminary Administrative Order; <br />and (d) correction of the typographical error of the 1981 credit rate of $4.57 to $4.77 on Page C-11 <br />MWMC Credit Rates; all of which have been incorporated in the attached Exhibit A. <br />D. Based on the findings and staff recommendations .set forth above, I find that the <br />Administrative Order - 1 <br />
