ADMINISTRATIVE ORDER N0.58-O1-18 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT. OF <br />FEES FOR RIGHT-OF-WAY CUT PERMITS AND REPEAL. <br />OF ADMINISTRATIVE ORDER N0.58-97-09-F. <br />The City Manager of the City of Eugene finds as follows: <br />A: Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. In accordance with the procedures set forth therein, and the further <br />authority of Section 7.300 of the Eugene Code, 1971, Administrative Order No. 58-97-09-F was <br />adopted on June 26, 1997, establishing right-of--way use permit fees. A portion of the fee schedule <br />adopted by Administrative Order No. S 8-97-09-F was subsequently amended and is incorporated in <br />the fee schedule adopted by Administrative Order No. 53-01-07-F. This order proposes an <br />amendment to the fees not included in the schedule attached to Administrative Order No. 53-01-07- <br />F. <br />;, <br />B. The Utility Permit Program has an objective to recover the full costs associated with <br />permitting and inspection. Fees necessary to achieve full cost recovery have been calculated by City <br />staff. Based on this calculation, an increase in permit and project fees is necessary in-order to <br />recover the full costs of the utility permit program, which staff has recommended be phased in over <br />a three-year period. The proposed permit fees as set forth in Exhibit A hereto, should begin, for the <br />first calendar year, upon the effective date of the final Administrative Order amending these fees, <br />and for the second calendar year, should begin January 1, 2003. During the calendar year 2003, an <br />updated review ofprogram costs will be performed by staff and recommendations made with respect <br />to the fees required to recover full program costs. Those fees would become effective January 1, <br />2004, or as provided in the administrative order adopting the fees. In addition to the proposed fees, <br />the reference should be amended to read "Utility Right-of--Way Use Permit Fees." <br />C. I have reviewed and concur with the staff s recommendations. The fees set forth in <br />Exhibit A hereto are consistent with applicable policies and directives of the City Council, <br />comparable to~ the fees established in other jurisdictions for providing such services, and are <br />necessary in order to comply with the City Council's directive and the requirements of Section 7.300 <br />of the Eugene Code, 1971, that all of the City's costs related to processing the applications for the <br />permits and inspecting the work during and after completion of the work be fully recovered. <br />On the basis of these findings, I order that: <br />Administrative Order - 1 <br />C:\W INDO WS\TEMP\0l Utili tyRO W 1 ao.wpd <br />~Op~( <br />
