judgment of the Utility Permit and Inspections Supervisor, a hazardous or dangerous condition exists <br />that affects the public health, safety and welfare, the notification requirement maybe waived and the <br />City may take necessary corrective action to remove the hazardous conditions and charge the costs <br />thereof to the responsible party without prior notification. EC 7.308 (3) <br />If more than one permittee has worked within the affected area, the Utility Permit and Inspections <br />Supervisor shall allocate the responsibility and cost for restoration and maintenance. Factors to be <br />considered in the allocation of responsibility include the nature of the. work each performed, the type <br />of deterioration occurring, when each permittee performed work, the kind of equipment and con- <br />struction techniques each used, and other such factors which maybe deemed relevant. EC 7.308 (2) <br />4.B IMPROVED PUBLIC WAY <br />For purposes of surface restoration and maintenance responsibilities of the permittee, an improved public <br />way is a public right-of--way upon which hard surface improvements such as street and alley pavements, <br />public sidewalks, or bicycle paths have been constructed. The permittee is responsible for maintaining <br />surface restoration of a utility orright-of--way cut upon an improved public way, until such time as <br />the City performs a street reconstruction or overlay upon the affected area. EC 7.308 (1) <br />Unless otherwise noted, the City of Eugene assumes NO responsibility for maintenance of any <br />improvement constructed under the authority of a Temporary Surfacing Permit (TSP). The <br />owner/applicant accepts all responsibility to maintain the surface and related improvements in a safe <br />condition: ` <br />4.C UNIMPROVED PUBLIC WAY <br />For purposes of surface restoration and maintenance responsibilities of the permittee, an <br />unimproved public way is a public right-of--way or public utility easement upon which hard surface <br />improvements such as street and alley pavements have not been constructed. The permittee shall <br />be responsible for maintenance of surface restoration of work performed within an unimproved <br />public way for a period of one year commencing upon the completion of the work.
