An individual right-of--way use permit is required, unless otherwise specified in a current annual <br />blanket permit, for an activity which affects the public way and meets an of the following <br />conditions: <br />1. The activity involves the removal and replacement of any City-owned facilities (e.g. street <br />pavement, trees, concrete curbs, sidewalks, or bike path). <br />2. The activity involves the relocation of the existing facility (e.g. changing the foot line or <br />elevation of underground facilities or moving existing poles or guy lines to a new location). <br />3. The activity involves the cutting of any root 2 inches in diameter or greater of a street tree <br />within the critical root zone of the street tree, or the cutting of a branch 2 inches in diameter <br />or greater of any street tree. <br />4. The activity involves installing more than 100 linear feet of pipe, conduit or cable. <br />5. The activity includes closing a lane of traffic on an arterial or collector street, or any street <br />within the downtown core area. <br />6. Excavation of existing material or placement of fill materials or aggregate in the right-of- <br />way. <br />7. The installation of facilities for the purpose of expansion or upgrade. <br />8 The activity involves installing facilities, cable, wire, or lines in an existing conduit installed <br />by another utility. <br />Permit fees, in the amounts set by the City Manager, shall be charged for all permits issued for work <br />within the public way unless otherwise noted herein. The amount of the fee shall be sufficient to <br />recover the City's costs related to processing the permit and inspection activities during and after the <br />work. EC 7.300 <br />2.A.1 A~roval and Issuance of Permit <br />Upon completion of review and determination that the proposed work is appropriate, the City <br />Engineer or designee shall approve the permit application. After approval, and upon receipt of the <br />required fee, deposit, performance bond, and proof of contractor's license and bond, the permit shall <br />be issued.
