INTERGOVERNMENTAL AGREEMENT <br /> ` City of Eugene and Lane County <br /> Pavement Preservation Project <br /> Manhole Adjustments <br /> a (Lancaster Drive M.P. A.OO to M.P. 0.16) <br /> City of Eugene Contract #2009-00253 <br /> This agreement is entered into by and between Lane County, a political subdivision of the State of <br /> Oregon ("COUNTY"), and the City of Eugene, a municipal corporation of the State of Oregon <br /> ("CITY"). <br /> WHEREAS, ORS 190.010 and the Lane County Home Rule Charter provide that units of local <br /> government may enter into agreements for the performance of any and all functions and activities <br /> that a party to the agreement, its officers or agents, have authority to perform; and <br /> WHEREAS, CITY desires to enter into an agreement with COUNTY to purchase the services as <br /> described in Exhibit B .(Statement of Work) and COUNTY is willing to provide such services on the <br /> terms and conditions set forth herein and in Exhibit A (City of Eugene Standard Contract <br /> Provisions) and Exhibit B, which are attached to this agreement; now, therefore; <br /> BOTH PARTIES AGREE THAT: <br /> CITY will compensate COUNTY for services up to a maximum of $10,000 as shown on Exhibit B. <br /> Any changes to Exhibit B that would result in an increase in the estimated costs as shown <br /> therein or be an expansion of the range of services to be provided during the term of this <br /> agreement will occur through written approvals by both parties in the form of an amendment to <br /> Exhibit B. <br /> Term of Agreement <br /> COUNTY shall commence with its performance on June 8, 2009, and shall complete all work <br /> prior to August 31, 2009. <br /> Compensation <br /> COUNTY will invoice CITY monthly for services rendered with detailed accounts of progress, <br /> based on outline of work detailed in Attachment A.
