Contractor is engaged in the business of tree planting services, and has obtained and <br /> currently holds all licenses, permits, certifications, bonds or other authorization required by <br /> Federal, State or local law or regulations to engage in such business. <br /> B. City desires to engage Contractor to perform the services described in the attached Exhibit <br /> B (the "Services"). Contractor has represented that it is qualified to perform the Services, <br /> and desires to enter into this contract with City on the terms set forth below. <br /> AGREEMENT <br /> 1. Engagement. City hereby engages Contractor to perform the Services, and Contractor <br /> agrees to perform the Services, according to the terms and conditions set forth herein and <br /> in the following exhibits: <br /> Exhibit A -City of Eugene Standard Contract Provisions <br /> Exhibit B -Request for Quotation 2006200043 <br /> Exhibit C -Schedule of Services & Quotation <br /> . 2. Term. The term of this contract shall be for one (1) year unless.earlier terminated in <br /> accordance with paragraph 16. The contract may be extended for two (2) additional one <br /> (1) yearterms mutual written agreement. <br /> 3. Consideration. As consideration for performance of the Services, City shall pay <br /> Contractor based on the quote as bid by Contractor and described in Exhibit C, plus or <br /> minus modifications requested by City and provided by Contractor at the hourly/unit rate <br /> bid. Payments shall be based on the price quoted for the service times the number of units <br /> of service provided. Payment. will be subject to acceptance of work by the City. Payments <br /> will be made from invoices provided by the Contractor, which shall be net 30. <br /> 4. Equipment.
