1 RTP GRANT PROGRAM AGREEMENT. <br /> 2 <br /> 3 <br /> 4 THIS AGREEMENT is made and entered into on the date of fmal signature of the Agreement by <br /> 5 and between the State of Oregon, acting by and through Oregon Parks and Recreation Department, <br /> 6 hereinafter referred to as the "State" and the City of Eugene, or designated representative, hereinafter - <br /> 7 referred to as the "Sponsor." <br /> 8 - <br /> 9 The parties agree to the following: <br /> 10 <br /> 11 WHEREAS, the Recreational Trails Program (RTP), authorized by the Transportation Equity Act for <br /> 12 the 21St Century (TEA-21), is a federal aid assistance program to help States provide and maintain <br /> 13 recreational trails for both motorized and non-motorized recreational use. Oregon Parks and <br /> 14 Recreation Department has been designated by the Governor of the State of Oregon to administer the <br /> 15 Recreational Trails Program for the State and will do so in accordance with the federal statutes <br /> 16 United States Code (23 U.S.C. 206) and federal, state, .and local program guidelines. <br /> 17 <br /> 18 WHEREAS, under ORS 390.980 Oregon Parks and Recreation Department may use any funds made <br /> 19 available by a federal agency for such purposes as the department determines are necessary or <br /> 20 desirable to carry out the purposes of the Oregon Recreation Trails System Act. <br /> 21 <br /> 22 The purpose of this Agreement is to set forth the obligations of both parties in the development of <br /> 23 RTP recreational opportunities, hereinafter called the "Project," which is described in the Sponsor's <br /> 24 RTP Grant Application. With this reference the RTP Grant Application is made a part of this <br /> 25 Agreement and more specifically describes the Sponsor's Project. <br /> 26 <br /> 27 -The State has sufficient RTP Grant funds available within its current biennial budget and has <br /> 28 authorized the expenditure on the Sponsor's Project as defined below. <br /> 29 <br /> 30 The Project has been reviewed and, based on the Sponsor's representations, is found to be feasible <br /> 31 and appropriate for funding. <br /> 32 <br /> 33 Project Title: Ridgeline Wayfinding & Trailhead Improvements <br /> 34 <br /> 35 Project Number: RTP 06-12 <br /> 36 <br /> 37 Project Funding <br /> 38 ICI <br /> 39 The total cost of the entire RTP project covered by this Agreement is $101,455. <br /> 40 - <br /> 41 The value of the Sponsor contributions for this Project is 38,105, which is the difference between the <br /> 42 total cost and the State grant. <br /> 43 <br /> 44 The State agrees to pay to the Sponsor 63,350 or 62.45 percent of the total project costs, whichever <br /> <br /> 45 amount is less, from monies available through the U.S. Department of Transportation, Federal <br /> <br /> 46 Highway Administration, and as specified in the Recreational Trails Program Federal Aid Project _ <br /> <br /> 47 Agreement. <br /> <br /> 48 <br /> <br /> 49 NOW, THEREFORE, the State and the Sponsor agree to the following: <br /> 50 <br /> RTP Grant Program /Revised 7/05 ~ ~ O ~ ~ O A Page 1 of 6 <br /> ~ y <br /> <br />
