GRANT AGREEMENT <br /> In consideration of the promises set forth below, the parties agree: <br /> 1. The project will begin on or about June 22, 2000 and end on or about August 30, 2000. <br /> 2. OYCC agrees to award amount indicated above to GRANTEE to develop and implement the <br /> projects described in the Project Proposal attached to this document as Exhibit A and incorporated <br /> by reference. Up to seventy-five percent of the grant amount may be requested at the onset of the <br /> project by submitting a memo of request. The balance of actual expenses incurred in carrying out <br /> the activities outlined in the Project Proposal will be paid at the conclusion of the project. Payment <br /> of these funds shall be within 60 days of OYCC approval of the Grantee's request for payment. The <br /> Project Final Report and Evaluations (form and evaluations to be supplied by OYCC) must be <br /> received by OYCC before final payment is made. <br /> 3. The GRANTEE agrees to use the entire amount of the Award and all matching funds for developing <br /> and implementing the projects described in the Project Proposal. <br /> <br /> 4. The GRANTEE agrees to incorporate OYCC's educational opportunities to enrich corps members' <br /> experiences including, but not limited to, access to natural resource experts, written materials, <br /> natural resource careers and understanding of environmental issues. Materials are available from <br /> OYCC as part of he crewleader training...... <br /> 5. The GRANTEE agrees to send the crewleader/supervisor to an OYCC sponsored or approved <br /> crewleader Training. The GRANTEE agrees to develop safety, work site, orientation, education <br /> and emergency plans in compliance with state and federal law and OYCC ,guidelines. Crew leader <br /> training will provide an opportunity for development of these plans. <br /> 6. The GRANTEE will comply with all applicable federal, state and local laws, rules, regulations or <br /> orders. Applicable laws and rules shall include, but are not limited to: Workers' Compensation <br /> Laws (ORS Chapter 656); Wages, Hours and Records Laws (ORS Chapter 652); Conditions of <br /> Employment Laws (ORS Chapter 653); Safety and Health Regulations (ORS Chapter 654); and <br /> Unemployment Insurance (ORS Chapter 657); Title VI of the Civil Rights Act of 1964; Section V <br /> of the Rehabilitation Act of 1973;-the Americans with Disabilities Act of 1990 and ORS 659.425; <br /> all regulations and administrative rules established pursuant to the foregoing laws; and all other <br /> applicable requirements of federal and state civil rights and rehabilitation statutes, rules and <br /> regulations. OYCC's performance under this Agreement is conditioned upon GRANTEE'S <br /> compliance with the provisions of ORS 279.312, 279.314, 279.316, 279.320 and 279.555 which are <br /> incorporated by reference herein. <br /> 7. The GRANTEE shall not use the Award to engage in any activities that violate federal or state <br /> antitrust and/or fair trade practices laws. Unlawful practices include, but are not limited to, <br /> monopolization, unreasonable restraints of trade and price fixing. <br /> 8. The GRANTEE shall indemnify and hold harmless the State of Oregon, OYCC, its officers, agents, <br /> employees, and members from all claims, suits, and actions resulting from or arising out of the <br /> activities of the GRANTEE or its subgrantees, agents, or employees in connection with this <br /> Agreement. Grantee shall carry appropriate insurance to cover the indemnity requirement. <br /> 2 <br /> <br />
