3Z.4 except for Union representation leaves as provided m Article 7, sick leave <br /> as specified in Article 26, and Family Medical and Parental Leave as <br /> specified in Article 27, employees ,are generally required to use accrued <br /> vacation, holiday and compensatory time prior to going on leave without <br /> paY• <br /> 32.5 In the event an employee going on leave without pay requests to save some <br /> paid leave time, the request must be made in writing and must specify the <br /> reason for saving paid leave. If the request is denied, the denial shall be in <br /> writing. <br /> Article 33 <br /> i <br /> 1 PERSONNEL RECORDS <br /> 33.1 The City shall maintain records relative to each employee's performance, <br /> including:. promotion, disciplinary actions, complaints or other matters <br /> relative to the status of an employee. The records shall be collectively <br /> referred to as the Personnel file. <br /> <br /> i <br /> 33.2 Personnel files of all employees shall be treated in accordance with <br /> Oregon's Public Records law. Access to the Personnel files shall be limited <br /> to authorized supervisory and management employees, and those clerical <br /> employees responsible for maintaining the files. Personnel files shall be <br /> available for inspection by an employee upon request. An employee may, <br /> by written authorization, grant a Union steward or other representative the <br /> right to inspect the employee's files. The employee or an authorized steward <br /> or representative may receive copies of documents or request a "certified <br /> copy" of the employee's personnel file. A charge may be assessed for <br /> providing the copies. Nothing in this Agreement shall be construed as a <br /> waiver of the Union's right to information to which it is entitled under the <br /> Public Employee Collective Bargaining Act (PECBA). <br /> 33.3 All documentation must be dated before inclusion in the Personnel file. No <br /> document may be used for performance evaluation or disciplinary action <br /> without an employee's knowledge. No document relating to performance or <br /> disciplinary action may be placed in an employee's personnel file without <br /> the employee's knowledge. Employees shall have the right to attach a <br /> statement of rebuttal to any information placed in the Personnel file. <br /> Article 34 <br /> DISCIPLINE AND DISCHARGE- <br /> 34.1 Discipline shall normally be progressive, beginning with oral reprimand and <br /> tin <br /> <br />
