Sample Response to a Grievance <br /> August 3, 1992 <br /> TO: Jan Jost, Employee <br /> cc: Dave Digger, Chief Steward <br /> <br /> i <br /> FROM: Don Dillinger, Division Manager <br /> . _ - _ - <br /> <br /> j Subject: .Step 2 Grievance Response <br /> In accordance with Article 32.3, Step 2, paragraph c., this is my response to your grievance filed on July 20, 1992. <br /> We met on July 27, 1992 to discuss this grievance. Those present with us were Bob Jones, AFSCME Council Rep, <br /> <br /> j Sue Snow, union steward, and Kim Kissinger, supervisor. <br /> <br /> ~ You allege in your grievance that Article 2.2, 4.1, and 16.3 have been violated. You have stated that you were not <br /> given a reasonable notice to 'take excess time off in lieu of holiday accruals when you exceeded the six day limit. <br /> <br /> i You ask that you be allowed to take off Aug<ist 20 and 21 instead. I will respond to each of the allegations <br /> <br /> ~ separately. <br /> Article 2.2 You have provided no information to support the allegations that this contract language has been violated. <br /> When I asked you why this Article was cited in the grievance, you responded that it was put in all grievances as a <br /> <br /> i matter of principal. My investigation into the matter finds no basis for a claim of discrimination. <br /> Article 4.1 You have provided no information to support the allegation that this contract language has been violated. <br /> The City has not exercised its management rights for the purpose of avoiding the terms of the Agreement. <br /> Article 16.3 You have stated that on July 10, 1992 you were notified by Kim Kissinger that you had reached the six <br /> day limit for accrual of time off in lieu of holidays. Kim scheduled you to take two days off sometime during the <br /> week of August 10 since this is the one week in the month when none of the other members of your work group were <br /> scheduled to be off. You told Kim that week was not acceptable to you since your in--laws were going to be visiting <br /> and you didn't want to be home with them. Kim asked you to consult with your co-workers to see if any of them <br /> would swap their scheduled time off with you.. You reported to Kim that none would do this. Consequently, Kim <br /> scheduled you off August 10 and 11. In evah?ating the situation anti reviewing the facts, I find no violation of the <br /> contract language. You were given a month's notice which I consider reasonable. Due to the operational needs of <br /> the work group; ie minimal staffing during peak vacation times in a continuous shift situation, your personal <br /> preference cannot be accommodated in this instance. The time you had accrued had to be taken off before the end of <br /> August in accordance with Article 16.2 before the September Labor Day holiday occurred. <br /> In summary, based on the information provided to me by you and Kim Kissinger, I find no violation of the Agreement <br /> and must deny your grievance. <br /> Supervisor's Guide January, 1996 <br /> Employee Relations Page 20 <br /> <br />
