City of Eugene <br /> Human Resource and Risk Services Policies <br /> SEE: Contact Human Resource and Risk Services for the Outside Em to ment <br /> <br /> ~ Request form. <br /> 3-216 Employees and Contract Work <br /> 3-216.1 Formal Bidding Process <br /> Employees may not enter bids for City contract work if the employee has or <br /> could have inside information about the bid, or is in charge of or holds a position <br /> of responsibility in the department which lets the bid. <br /> 3-216.2 Definition of Independent Contractor <br /> Determining whether or not a particular worker is an employee or an <br /> independent contractor has legal significance. Improper categorization of an <br /> employee as a contractor can create liability under income tax, workers <br /> compensation and pension laws. Contact Human Resource and Risk Services <br /> for assistance. <br /> ORS Chapter 670.600 provides the following standards for an independent <br /> contractor. The individual or business entity providing the labor or services: <br /> a) is free from direction and control over the way the work is done, <br /> b) is responsible for obtaining all applicable business registrations or <br /> licenses. <br /> c) furnishes the necessary tools or equipment, <br /> d) has the authority to hire and fire other employees to perform the <br /> labor or services, <br /> e) receives payment upon completion of the performance or on an <br /> annual or periodic retainer, <br /> f) represents to the public that they are an established business. <br /> g) must be legally eligible to work in the United States (this includes <br /> student interns). <br /> 3-217 Gifts, Sponsorships, Charitable Contributions and Memberships (revised 10/19/99) <br /> 3-217.1 Gifts and Discounts to City Employees <br /> From time to time, offers of gifts, discounts or other financial benefits are made available <br /> Human Resource and Risk Services Revised: 09/16/02 <br /> <br />
