The decision ot~ the arbitrator shall be final and binding on both <br /> parties. <br /> 5) Each grievance will be submitted at a separately convened <br /> arbitration hearing unless the parties agree mutually to submit more <br /> than one (1) grievance at the same arbitration hearing. The cost of the <br /> impartial arbitrator and court reporter or stenographer if requested by <br /> the arbitrator, and transcript of the hearing furnished to the arbitrator <br /> shall be shared equally by the parties. Each party shall be responsible <br /> for all costs of presenting its position to the arbitrator. All meetings <br /> and hearings under this procedure shall be kept informal and private, <br /> and shall include only the parties in interest and/or designated <br /> representatives referred to in this procedure. <br /> 35.7 OPTIONAL MEDIATION <br /> As an alternative to arbitration, the parties may mutually agree to grievance <br /> mediation. Such attempt at mediation shall not constitute a waiver of the <br /> right to seek arbitration and shall constitute a waiver of time limits specified <br /> herein pending the outcome of the mediation process. <br /> 35.8 The parties agree that this Agreement and its provisions are to be enforced <br /> solely through the grievance procedure or as otherwise expressly specified <br /> herein. <br /> Article 36 ' <br /> CAREER DEVELOPMENT ASSISTANCE PROGRAM <br /> 36.1 The City and the Union shall jointly sponsor and support the Career <br /> Development Assistance Program (CDAP), a program which assists <br /> employees who wish to develop. their careers. The CDAP provides a <br /> variety of career development tools, resources, and opportunities for <br /> employees. The CDAP will be periodically reviewed by the JLMRC. <br /> <br /> 3.6.2 A career development plan is a tool to assist employees in achieving their <br /> career goals. The plan identifies an employee's career goals, outlines steps <br /> to accomplish the goals, and tracks progress. Employees are not required to <br /> complete a plan to access any of the career development tools, resources or <br /> opportunities. The plan does not guarantee training opportunities, a <br /> promotion, a career development assignment, or any other resource or <br /> opportunity offered by the CDAP. <br /> FC. <br /> <br />
