<br /> MEMORANDUM OF UNDERSTANDING
<br /> PARTIES:
<br /> This is a Memorandum of Understanding (MOU) between School District 4J (4J), the City of
<br /> Eugene (COE) and the Faith Center Church (FCC).
<br /> SUBJECT:
<br /> The MOU concerns the improvement of the unimproved portion of 14th Avenue, from,
<br /> approximately, the 4J property line on the east, to Chambers Street on the west, hereafter
<br /> called the Work. The improvement is a 28 feet wide street, with curbs, gutters, trees and
<br /> lighting to meet City of Eugene Standards.
<br /> i
<br /> FINANCING:
<br /> The cost of the Project is estimated to be $590,000, delineated as follows: Construction cost
<br /> (1~Jork): $451,838, Soft costs: including design ($55,000), COE inspection ($16,000), 4)
<br /> administration (a fixed $22,592) and contingency ($44,570), for a total of $138,162.
<br /> I
<br /> Lane County, Board of Commissioners, has approved School District 4J's request for
<br /> $472,000 from the Community Development Road Improvement Assistance Fund (CDRIAF).
<br /> The remaining funding, $118,000, is to be provided by the City of Eugene ($66,000) and
<br /> Faith Center Church ($52,000).
<br /> City of Eugene Funds:
<br /> Upon the successful completion of the improvements, as designated by a certificate of
<br /> substantial completion issued by the design consultant, and acceptance of the public
<br /> ' improvements by the COE, at the request of 4J, COE will pay their portion in a check made
<br /> out to the 4J in the amount of $66,000.
<br /> j Faith Center Church Funds:
<br /> Upon the successful completion of the improvements, as designated by a certificate of
<br /> substantial completion issued by the design consultant, and acceptance of the public
<br /> improvements by the COE, at the request of 4J, FCC will pay their portion in a check made
<br />
<br /> i out to 4J in the amount of $52,000.
<br /> Cost Overruns:
<br /> i Soft Cost Overruns - If at any time during the course of design or construction, there is an
<br /> j occurrence that will cause a soft cost overrun, the parties will meet and determine a course
<br /> of action or agree to an allocation of costs exceeding the budget.
<br /> Construction Cost-Overruns - If at bid opening the cost of the Work exceeds the budget
<br /> i ($451,838) the' parties will meet and determine how to reduce the scope of-the Work to
<br /> bring the project within it's budget or agree to an allocation of the costs exceeding the
<br /> budget. If at any time during the construction phase of the project, there is an occurrence
<br /> that will cause a cost overrun, the parties will meet and determine a course of action, or
<br /> agree to an allocation of the costs exceeding the budget.
<br /> If there is an overrun that requires an allocation, 4J will contribute up to $5,900 (5% of
<br /> $118,000). 4J will have no other responsibility for extra construction costs, except those
