policies and procedures of the City's Utility and Right-of-Way Manual for construction <br /> within the public way and the City Standard Specifications. <br /> 10. Maintain protective tree fencing damaged by the Work, meet the requirements that <br /> are shown on City Standard Tree Protection Drawing E-97 and comply with all City <br /> Tree Protection Standards. At this time the City is aware of three trees located within <br /> the Project site, at approximate Project Station 39+40 (right side), 39+65 (right side) <br /> . and 52+20 (right side), that have major roots over 2 inch diameter that shall not be <br /> cut or torn during trenching with equipment. Within these areas, pipe installation <br /> may need to be installed by hand digging or tunneling under roots, as necessary, to <br /> avoid cutting the roots 2 inch and larger. <br /> 11. Provide the necessary erosion prevention measures for all of the Work performed to <br /> be in compliance with EC 6.630(2) and Administrative Rule R-6.645. The intent of <br /> those provisions is to ensure that construction related activities prevent or minimize <br /> erosion, sedimentation, and other storm water related problems. <br /> 12. Discard ground water extracted from the Work in an acceptable manner without <br /> damage to adjacent property,. City's storm water system, water features, and related <br /> natural resources. <br /> 13. Be responsible for all damage by the Work to public or private property resulting from <br /> EWEB's failure to properly protect people and properly while carrying out the Work. <br /> EWEB will take care when working around shallow sewer laterals. <br /> CITY AGREES TO: <br /> 1.- Allow EWEB#o access-areas of Milyard Street needed to perform the Work-during - - <br /> the Project. <br /> 2. Allow EWEB to perform the Work under City Contract traffic control measures <br /> (TCM), per the agreed upon schedule within the Project. <br /> 3. Remove the existing pavement within the Project limits. <br /> 4. Periodically monitor operations performed by EWEB to see that the Work is <br /> performed according to Project Specifications. The City may require changes in <br /> construction technique or workmanship if it does not conform to the Project Plans <br /> and Specifications. <br /> 5. Submit billings to EWEB for all actual extra-costs to the City for the Project, for delay <br /> <br /> . or loss of production Project costs incurred by the City, and for additional engineering . <br /> costs attributable to City making. accommodations for EWEB to perform its Work <br /> within the City Project site. These costs include, but are not limited to, remobilization <br /> costs incurred by the City as identified in the Project Bid Schedule, extra traffic <br /> control measures required by the Work that are not identified on the Project <br /> Construction Plans, extra subgrade stabilization costs as identified. in the Project <br /> Specifications that are required due to EWEB's Work activities, additional trench <br /> compaction testing, additional subgrade testing, any delay or loss of production costs <br /> <br />
