Document Number: 11423 <br /> Intergovernmental Agreement <br /> BETWEEN: Eugene Water & Electric Board (EWEB) <br /> AND: The City of Eugene <br /> Water Main Replacement for Hilyard Street Reconstruction Project from 13~' to 24th <br /> THIS INTERGOVERNMENTAL AGREEMENT, hereinafter referred to as "Agreement" is <br /> made and entered into by and between the Eugene Water & Electric Board hereinafter <br /> referred to as "EWEB," and the City of Eugene hereinafter referred to as "City." The City <br /> and EWEB are herein referred to jointly as the "Parties." <br /> RECITALS <br /> By the authority granted in ORS 190.010, which; allows governmental bodies to-enter into <br /> agreements for the performance of any or all functions and activities that the Parties to the <br /> Agreement, their officers, or agents have the authority to perform. <br /> ° WHEREAS, the City is performing street reconstruction work on Hilyard Street between 13tH <br /> Avenue and. 24th Avenue and in 2006, City will be constructing improvements (referred to <br /> herein as the "Project") to a portion of Hilyard Street from 13~' Avenue to 24~' Avenue, which <br /> is within City's right-of--way. The Project typically includes excavating of the existing road, <br /> replacing the road base. and. repaving .with asphalt concrete.- .EWEB has requested the City - <br /> to stage construction of the Project to accommodate EWEB work to construct a 6 inch water <br /> main installation and the associated water services, street crossings, testing and <br /> chlorination (referred to herein as the "Work") for the entire length of the Project by EWEB <br /> personnel'and forces. <br /> The Work excludes the intersections on Hilyard Street at 13~' Avenue, 18th Avenue and at <br /> 24'h Avenue. At these intersections, EWEB will install all replacement facilities before the <br /> City construction improvements begin; <br /> NOW THEREFORE, the Parties have agreed to accomplish that work as follows: <br /> TERMS OF AGREEMENT <br /> The term of this agreement shall begin upon its execution and continue through the <br /> completion of the work, and there after shall expire. <br /> EWEB AGREES TO: <br /> 1. Furnish suitable and, sufficient materials, equipment, and personnel to properly <br /> prosecute the Work within timelines established by this Agreement. This includes <br /> performing the Work in a way that will minimize interference and delay for all forces <br /> working within the Project: EWEB will provide work crews as required until the Work <br /> is completed. <br /> <br /> _ _ <br /> <br />
