City of Eugene /State of Oregon -Dept of Transportation <br /> Jurisdictional Transfer Agreement No. 777 <br /> 6. State maintains a state route system to assist the motoring public in their travels. <br /> Designated .routes may be composed of both state highway and local roads. <br /> Designation and elimination of state routes are under authority of the OTC. The <br /> portion of the highway proposed for transfer has been designated to carry OR 99 <br /> and OR 126B. <br /> 7. For the purpose of providing acceptable traffic patterns on public highways, the <br /> Parties Ian and ro ose to eliminate from the state hi hwa s stem a ortion of <br /> p p p 9 Y Y p <br /> Pacific Highway West from mile point 123.30 on 6tn Avenue and 123.37 on 7m <br /> Avenue to mile point 125.48, hereinafter referred to as Unit A. <br /> NOW THEREFORE, the premises being in general as stated in the foregoing recitals, it is <br /> agreed by and between the Parties hereto as follows: <br /> TERMS OF AGREEMENT: <br /> 1. Subject to the provisions of this Agreement, the. Parties agree, conditioned upon <br /> approval by the OTC, that Unit A be eliminated as a portion of Pacific Highway West <br /> and the state highway system; that Unit A pass to and vest in City; and that City <br /> maintain the Unit as a part of its city street system as long as needed for the service <br /> of persons living thereon or a community served thereby. If said right of way is no <br /> longer used for public street purposes, it shall automatically revert to State. The <br /> location of Unit A is approximately as shown on the sketch map attached hereto, <br /> marked Exhibit A, and by this reference made a part hereof. <br /> 2. As a condition of the transfer of Unit A from State to City, the Parties agree that City <br /> shall administer a contract to overlay the pavement of Unit A using a maximum of <br /> $1,611,188 in State funds. Any costs that exceed $1,691,188 for the new overlay <br /> shall be paid by City. The overlay work shall be completed within 10 calendar years <br /> following the date of final execution of this Agreement by both parties unless <br /> extended by a fully executed amendment. <br /> <br /> 3. This Agreement becomes effective on the date all required signatures are obtained <br /> and terminates upon acceptance and recording of the transfer document or two <br /> calendar years after the effective date of the Agreement, whichever is earlier, unless <br /> otherwise extended or renewed by formal agreement of the Parties. The State shall <br /> .pursue approval by the OTC and the actual transfer of property shall be <br /> accomplished by recording of the Jurisdictional Transfer Document. If this <br /> Agreement is terminated upon completion of the transfer then the following <br /> provisions shall survive such termination: Terms of Agreement, Paragraphs 2, 4 and <br /> 5; State Obligations Paragraph '2; City Obligations, Paragraphs 6 and 7; and <br /> General Provisions, Paragraph 4. <br /> 2 <br /> _ <br /> <br />
