Jurisdictional Transfer Agreement <br /> No. 777 <br /> City .of Eugene #2007-00205 <br /> JURISDICTIONAL TRANSFER AND <br /> COOPERATIVE IMPROVEMENT AGREEMENT <br /> OR 126 BUS: Washington Street -Walnut Street <br /> MP 123.30/MP 123.37 to MP 125.48 <br /> Pacific Highway West, State Highway No. 91, County of Lane <br /> City of Eugene <br /> THIS AGREEMENT is made and entered into by and between the STATE OF <br /> OREGON, acting by and through its Department of Transportation, hereinafter referred <br /> to as "State" and the CITY OF EUGENE, acting by and through its designated. officials, <br /> hereinafter referred to as "City," referred to hereafter collectively as the "Parties". <br /> RECITALS <br /> 1. Pacific Highway West, also known as State Highway No. 91, is under the jurisdiction <br /> and control of the Oregon Transportation Commission (OTC). The portion of Pacific <br /> Highway West which is easterly from its junction with the Eugene-Springfield <br /> Highway (anc~ route I-105), is designated to carry State Routes OR 99 and OR <br /> 1266. <br /> 2. By the authority granted in ORS 190.110, 366.572 and 366.576, State may enter <br /> into cooperative agreements with counties, cities and units of local governments for <br /> the performance of work on certain types of improvement projects with the allocation <br /> of costs on terms and conditions mutually agreeable to the contracting Parties. <br /> 3. By the authority granted in ORS 366.395, State may relinquish title to any of its <br /> property not needed by it for highway purposes to any other governmental body or <br /> political subdivision within the State of Oregon, subject to any restrictions imposed <br /> by deed or other legal instrument or otherwise imposed by State. <br /> 4. Pursuant to ORS 373.010, whenever the routing of any state highway passes <br /> through the corporate limits of any city, State may locate, relocate, reroute, alter or <br /> change any routing when in its opinion the interests of the motoring public will be <br /> better served. <br /> <br /> 5. By the authority granted in ORS 810.210, State is authorized to determine the <br /> character or type of traffic control devices to be used, and to place or erect them <br /> upon state highways at places where State deems necessary for the safe and <br /> expeditious control of traffic. No traffic control devices shall be erected, maintained, <br /> or operated upon any state highway by any authority other than State, except with <br /> its written approval <br /> <br />
