INTERGOVERNMENTAL AGREEMENT <br /> BETWEEN: The City of Eugene, an Oregon (City) <br /> municipal corporation 1,~~ ~1~ <br /> AND: Sta <br /> a Board Higher ~duca~n <br /> on~ ~ (Univers <br /> behalf of the University of Oregon <br /> CONTRACT NO.: 2008 - 00213 <br /> EFFECTIVE DATE: October 1, 2007 <br /> RECITALS <br /> A. ORS 190.110 provides that a unit of local government and a state agency may <br /> enter into an agreement to cooperate for any lawful purpose. <br /> B. The City has studied flooding problems associated with the Eugene Mill Race and <br /> reported conclusions of the studies in the City of Eugene Mill Race Capacity Study, <br /> dated October 2006 (Mill Race Study). <br /> C. The City and the University wish to cooperatively address the flooding problems <br /> described in the Mill Race Study. It will mutually benefit the parties if they <br /> cooperate as described in this Agreement. <br /> D. The City and the University desire to enter into an agreement whereby each will <br /> provide the services described in this Agreement on the terms and conditions set <br /> forth herein. <br /> AGREEMENT <br /> 1. Services to be Provided. The University of Oregon will benefit from a new <br /> stormwater pipe connecting to, and draining, catch basin number 56822 at or <br /> below the lowest existing University of Oregon connection to the catch basin. <br /> This improvement would significantly improve stormwater function in-the existing <br /> University of Oregon stormwater system that is connected to catch basin number <br /> 56822 below the existing invert of the City of Eugene's outflow pipe. A new <br /> stormwater pipe between catch basin number 56822 and stormwater manhole <br /> number 68517 will be constructed. The upstream invert of the pipe will be laid at <br /> or below the downstream invert of the lowest existing University of Oregon pipe <br /> invert entering catch basin number 56822. The general location of the project <br /> area is shown on the map attached as Exhibit A. The City and the University <br /> each agree to cooperate in the project as described below: <br /> <br /> This cover sheet and the City's original contract are to be sent to the City Recorder's <br /> Office. The contractor should receive one original. The department is advised to keep a <br /> <br /> copy of the contract. <br /> <br />
