The term of this Agreement shall begin on the date all required signatures are <br /> obtained and terminate upon completion of the Roadway Project construction. <br /> CITY OBLIGATIONS <br /> 1. City shall, at ODOT's expense, conduct the necessary preliminary engineering and <br /> design work required to produce final plans, specifications and costs estimates,,. <br /> obtain any required right-of--way in City's name; obtain any required permits and <br /> perform all construction necessary for completion of the Contractor Detour Route. <br /> 2. In acquiring right-of--way, City shall follow the federal and state law procedures and <br /> obligations set for the in the Uniform Relocation and Real Properties Acquisition <br /> Policies Act of 1970, as amended; ORS 281.060; ORS 35.346 and the ODOT Right- <br /> of-Way Manual, Requests for the Authorization to Proceed with Acquisition <br /> activities and the Right-of-Way Certification will be routed through ODOT's Region 2 <br /> Right-of--Way office. <br /> 3. City shall, upon execution of this Agreement, forward to ODOT a letter of request for <br /> their contribution by way of check, warrant or irrevocable letter of credit in the <br /> amount of $12,00.0 for ODOTs portion of the Contractor Detour Route. Under no <br /> conditions shall ODOTs obligations exceed $12,000, including all expenses: <br /> Should this Agreement be terminated prior to completion of the Contractor Detour <br /> Route, City shall reimburse ODOT for its portion of the Contractor Detour Route. <br /> 4. City shall allow the use of its roads for the construction of the Roadway Project. <br /> 5. City hereby grants ODOT the authority to enter onto and occupy City right-of--way for <br /> the work described in this Agreement. <br /> 6. City shall provide written acceptance of the finale condition of the Contractor Detour <br /> Route prior to completion of the Roadway Project. If the condition is unacceptable, <br /> - City and ODOT shall together determine the repair work needed to return' the <br /> roadway back to the condition it was in prior to use as the Detour Route. <br /> 7. All employers, including City, that employ subject workers who work under this <br /> Agreement in the State of Oregon shall comply with ORS 656.017 and provide the <br /> required Workers' Compensation. coverage unless such employers are exempt <br /> under ORS 656.126. City shall ensure that each of its subcontractors complies .with <br /> these requirements. <br /> 8. City acknowledges and agrees that ODOT, the Secretary of State's Office of the <br /> State. of Oregon, the federal government, and their duly authorized representatives <br /> shall have access to the books; documents, papers, arid records of City which are <br /> directly pertinent to the specific -Agreement for the purpose of making audit, <br /> examination, excerpts, and transcripts for a period of three years after completion of <br /> <br /> Key no. 10349 2 <br /> <br />
