THIS AGREEMENT is made and entered into by and between THE STATE OF <br /> OREGON, acting by and through its. Department ofTransportation, hereinafter referred <br /> to as "ODOT; and THE CITY OF EUGENE, acting by and through its designated <br /> officials, hereinafterreferred to as "City". <br /> RECITALS <br /> 1. OR 99W, also.. known as Pacific Highway West, is a part of the state highway <br /> system under the jurisdiction and control of'the Oregon Transportation Commission. <br /> Garden Way, Coburg Road and Country Club Road are a part of the city .street <br /> system under the jurisdiction and control of City. <br /> 2. By the authority granted in ORS 190.110, 366.572 and 366.576, ODOT may enter <br /> into cooperative agreements with the counties, cities, and units of local governments <br /> for the performance of work on certain types of improvement projects with 'the <br /> allocation of costs on terms and .conditions mutually agreeable to the contracting <br /> parties: <br /> NOW THEREFORE, the premises being in general as stated in the foregoing recitals, it <br /> is agreed by and between the parties hereto as follows: <br /> TERMS OF AGREEMENT: <br /> 1. For the purpose of providing acceptable traffic patterns on City and ODOT roadways <br /> during the construction of ODOTs i-105- Willamette River - Pack Highway project, <br /> hereinafter referred to as "Roadway Project", ODOT and City agree to improve <br /> Garden Way, on which the City currently is conducting a roadway improvement <br /> project, and use this portion of roadway for the routing of contractor track traffic <br /> during the construction of the Roadway Project, hereinafter referred to as <br /> "Contractor .Detour Route", as shown in Exhibit A attached hereto and by this <br /> reference made a part hereof..The improvements to the Contractor Detour Route' <br /> include reinforced PCC driveways and added asphalt concrete depth to Garden <br /> Way. <br /> 2. ODOT shall use the funds available for the Roadway Project to contribute to the <br /> Contractor Detour Route under this Agreement.
