Provide a permanent forest cover subject to active forest management for <br /> improving and maintaining the health of the oak woodlands end to control <br /> invasive species. <br /> e. Prohibit residential development and significant surface and subsurface <br /> disturbance such as mining and drilling, and prohibit industrial or commercial <br /> uses that would conflict with the goals of the FLP and the State's AON. <br /> f. Develop and revise as needed a Forest Stewardship Plan or other multi-resource <br /> forest management plan to guide the management of the property. <br /> 3. In acquiring #his land, ODF in partnership with the City of Eugene shall ensure that; <br /> a. The landowner is informed of the fair market value and is notified in writing that <br /> eminent domain will not be used. <br /> b. The title is free and unencumbered or that title insurance is secured in fhe name <br /> of the City of Eugene for the full value of the encumbered property. Any <br /> encumbrance to the title must be deemed by the State as not affecting the <br /> purpose for which the interests in the land is being acquired. <br /> c. The. consideration paid to any landowner by this grant for the conveyance to the <br /> City of Eugene of any lands is no more than the fair market value of the <br /> conveyed (ands as determined by an appraisal done by an appraiser licensed in <br /> Oregon. Any appraisal shall conform to the Uniform Appraisal Standards for <br /> Federal Land Acquisitions (interagency Land Acquisition Conference, 2000). A <br /> qualified review appraiser will attest to Federal Appraisal Standard conformance <br /> (documentation to be provided to the USDA,Fores# Service (FS)). <br /> d. Non-Federal entities shall provide at least 25 percent of total program costs. <br /> This share of costs may be cash and/or in-kind services or contribution. <br /> Donations of lands That Oregon intends to use as part of the non-Federal cost- <br /> . share match must be documented and subsequently submitted to FS. <br /> Documentation should address the following: <br /> 'r. The donation contributes to the objectives and priorities of the state's <br /> FLP as set forth in the AON. <br /> ii. AlI or part of the donation is within the boundaries of the FLP area. <br /> iii. The donor specifically requests that the value of the interest be used <br /> <br /> ° as anon-Federal match forthe FLP at the time of the transfer. <br /> iv. The donation of an interest in land must-contain perpetual covenants to <br /> assure that the tract will be~managed in a manner compatible with the <br /> goals for which the Forest Legacy area was established. <br /> v. The deed contains a clause that directs all of the easement holder's <br /> proceeds form a subsequent sale or exchange of the easement be <br /> used in a manner consistent wifh the conservation purposes of the <br /> easement. <br /> vi. The donation must not have been previously credited towards any <br /> . other FLP non-Federal match. <br /> <br />
