Biannual Progress Reports are due to the ODFW Project Manager, Martin Nugent, in hard copy and <br /> ~ 60 electronic format. <br /> 61 <br /> 62 Within 60 days after completion of the project, Recipient must submit a final report in hard copy and electronic <br /> 63 format. <br /> 64 <br /> 65 Hard copies of these reports should be mailed to the project leader, Martin Nugent at: ODFW, P.O.Box 59, <br /> 66 Portland, OR 97207. As of August 15, 2003, Contractor shall submit hard copies of reports to 3406 Cherry Avenue, <br /> 67 NE, Salem, OR 97303. Electronic copies of these reports should be emailed to: Martin.Nugent(a~state.or.us. <br /> 68 <br /> 69 II. RECIPIENT ACTIONS <br /> 70 <br /> 71 The Recipient hereby agrees to be responsible for proper administration of all costs associated with the <br /> 72 administration of the project. Recipient also agrees to oversee the project with due diligence and to fulfill the terms <br /> 73 for Recipient Actions as specified below: <br /> 74 <br /> 75 A. Contribute. The Recipient will contribute the total sum of $56,620 or 44% of the total project cost. <br /> 76 <br /> 77 If any project cost saving is realized, all parties shall share equally in the cost saving. See VI.G. Cost SayinQS of this <br /> 78 agreement. <br /> 79 <br /> 80 B. Pay all Costs Due to Unauthorized Changes. Failure to notify the Department of any changes to the project as <br /> <br /> ' 81 agreed to herein shall cause costs related to said changes to be charged to the Recipient as a cost ovemw. This <br /> 82 Department shall make reimbursement only for the portion of the project as approved and specified in this <br /> 83 Agreement by the Department. <br /> 84 <br /> 85 If the Recipient proposes changes to the project while the project is in progress, the Recipient shall request an <br /> 86 Amendment to this Agreement as specified in Article II.E. below. <br /> 87 <br /> 88 Formal contractual commitments signed by or agreed to by the Recipient authorizing change orders, term extensions <br /> 89 or other contractual obligations related to the project prior to an Amendment request to the Department shall be the <br /> 90 sole obli anon of the Reci tent as a cost <br /> g overrun. <br /> l? <br /> 91 <br /> 92 Retroactive review by the Department of any project changes made by the Recipient shall be solely for the purpose <br /> 93 of assuring that the integrity of the project based on this Agreement is preserved; and to assure that the project has <br /> 94 not deviated to a purpose and use not intended by this Agreement. <br /> 95 <br /> 96 Review of unauthorized changes shall not require reimbursement by the Department notwithstanding the fact that <br /> 97 they maybe associated with the project. <br /> 98 <br /> 99 C. Provide Notice of Intent to Complete the Protect. Unless terminated or extended, the budget period of this <br /> 100 Agreement shall expire when the Department accepts Recipient's completed performance or on May 12, 2005, <br /> 101 whichever occurs first. The Recipient shall notify the Department in writing, at least 30 days prior to completion <br /> -102 date of it's intent to complete the project by the date specified herein.
