Ratification <br /> . to <br /> i Interagency Agreement 001-3197-S-Wildlife <br /> ~ City Of Eugene <br /> j East Alton Baker Park Habitat Restoration <br /> i <br /> j This Ratification is to the above referenced Interagency Agreement (Agreement) initiated <br /> by Martin Nugent and funded by USFWS, Division of Federal Aid, WCRP Program <br /> (R-4-1). This Agreement is between the State of Oregon; acting by and through its <br /> Department of Fish and Wildlife, hereafter referred to as ODFW, and the City of Eugene, <br /> ~ hereafter referred to as Contractor. <br /> I <br /> 1 <br /> ~ We are ratifying this Agreement to allow the effective date to be retroactive to May 14, <br /> ~ 2003: The USFWS Federal Aid WCRP grant that funds this project became effective on <br /> ~ this date. The Program Manager, Martin Nugent, allowed Contractor to initiate work on <br /> i May 14, 2003 without a~fully-executed Agreement in place. Martin understands that on <br /> future agreements, Contractors will not be allowed to start work before agreement <br /> between ODFW and Contractor.have been fully-executed. <br /> Ratification <br /> ~ Whereas the Contractor began performing under the Agreement prior to the Agreement <br /> being fully-executed; <br /> Whereas Contractor and Agency have authority to enter into the Agreement; and <br /> therefore, ODFW, acting by and through its highest contracting authority, hereby ratifies <br /> the Agreement, with an effective start date of May 14, 2003. ODFW's authority to pay <br /> the Contractor under this Agreement are contingent on ODFW receiving from the Oregon <br /> Legislative Assembly appropriations, limitations, or other expenditure authority sufficient <br /> to allow ODFW, in the exercise of its reasonable administrative discretion, to continue to <br /> make payments this Agreement to fund this project. <br /> Approved by: l <br /> <br /> i afore) ate) <br /> Pam Ryan <br /> Deputy Director for Administration <br /> _ _ <br /> _ _ _ <br /> _ _ <br /> <br />
