If the proposed project will not affect ESA listed or proposed species or critical habitat, a No Effects <br /> <br /> ' Memorandum will be prepared to document City compliance withthe-ESA, per ODOT approved format, <br /> and include a description of the project location, proposed action especially components related to the No <br /> Effect deternnation, a description of the evaluation methods, habitat types and conditions relevant to <br /> ESA species, a brief summary of the ESA species within the project area, evaluation of potential impacts <br /> of the project to ESA species or critical habitat and project' design or implementation measures to avoid <br /> impacts, and a determination of effects. This task shall involve up to six meetings to learn about the <br /> project design, contact appropriate agencies for infom~ation regazding listed or proposed species, review <br /> the Biological Baseline Report for information, and conduct up to two site visits to the project azea to <br /> survey and document existing site wnditions. It will also include a draft ghost transmittal letter to <br /> FIIWA. <br /> •Deliverables: One draft No Effects Memo and ghost transmittal letter regarding ESA issues in hard copy <br /> and electronic format to the City. <br /> Estimated due date: March 1, 2009 <br /> Task 3.2-Preparation of Biological Assessment (BA) <br /> Environmental Solutions LLC will prepare a Biological Assessment (BA) if it is determined that the <br /> project will have a May Affect, Likely to Adversely Affect (LAAS) or Not Likely to Adversely Affect <br /> (NLAA) determination on listed and proposed species or critical habitat. The BA shall be prepared <br /> according to ODOT guidelines and in the template format provided by ODOT. The draft BA will include <br /> all project information necessary tp complete ESA consultation; demonstrate professional expertise in the <br /> subject and include figures, tables, and appendices as needed. Environmental Solutions LLC shall attend <br /> up to ten meetings to Team about the project design elements, review the Biological Baseline Report, <br /> ORNHIC data base, contact agency biologists (USFWS, ODA, NMFS, ODFW) for site specific <br /> infomration regarding ESA species, conduct up to two site visits to survey and document site conditions, <br /> facilitate and attend up to two onsite meetings with the City, ODFW, Corps, NMFS, and/or USFS agency <br /> representatives to discuss the project and measures to avoid, minimize, or mitigate impacts. This will <br /> include a Botanical Clearance Report, a discussion of plans to avoid or minim;ze impacts to migratory <br /> birds ,identification of noxious weeds, and bats. This will include revisions to the document based on <br /> response from City and ODOT reviews. <br /> Deliverables: One copy of the draft BA in hard copy and electronic format. Because of the timing of the <br /> BA, rare plant surveys will not be able to be conducted at the blooming period, therefore those will be <br /> conducted after the BA has been submitted, if necessary based on habitat types present on the site. The <br /> cost for conducting a maximum of 3 additional plant surveys during the proper blooming period for <br /> suspect species has been included in the Cost Table for this task. <br /> Estimated due date: March I5, 2009 <br /> Task 4-Project Closeout <br /> Environmental Solutions LLC shall provide to the City an electronic file and a hard copy file of all fatal <br /> documents prepared. <br /> Deliverables: Electronic file and a hard copy file of all final documents prepared. <br /> Estimated due date: Apri130, 2009 <br /> 2.0 COST AND METHOD OF COMPENSATION <br /> The estimated fees for completion of Tasks 1-4 described above shall not exceed $22S 10.00, which <br /> includes payment of allowable expenses. Payment for services will be made upon receipt of <br /> Environmental Solutions LLC billing statement for work completed to date.
