01/22/07 14:07 FAX 541 68L 5~1UL l:l'1'Y r;UU t'11vHlvl.rr ~~~~ <br />. i ~~- <br />i <br />., ~ <br />TRUST AGREEMENT ' <br />s <br />BETWEEN: City of Eugene ~ ("City") <br />~ AND; ("Trustor"'~ <br />_ I <br />' I <br />DATE: December 20, 1994 <br />RECITALS <br />WHEREAS, City owns and maintains a city recreational park known as Alton <br />Baker Park; and <br />WHEREAS, Trustor desires to make an anonymous gift to the city for the <br />establishment of a fund to create and maintain a free garden within Alton Baker Park to <br />be known as the "Hays Memorial Tree Garden;" and <br />.WHEREAS, ORS 192.502(3) provides that Information may be submitted to a <br />public body in confidence where the public body obliges itself in good faith not to <br />disclose the information; and <br />i <br />WHEREAS, City has determined, pursuant to Administrative Order No_ 44-92- <br />1 S, that the approximate do(Iar value of the services provided by the City hereunder are <br />$5,000_ ' <br />AGREEMENT <br />1. Trustor shall, on or prior to December 31, 1994, tender to City the sum of One <br />Hundred Thousand and No/Dollars ($100,000.00) (the "Trust Funds")_ ~: <br />2. In order to maintain the Trust Funds, +City shall set up two separately managed <br />expendable sub-trust funds, to be administered pursuant to paragraph 4_ below, and <br />known collectively as the "Hays Trust Fund." <br />3. ~ City shall .maintain in confidence the source of the Trust Funds pursuant.to ORS <br />192.502(3)_ ; <br />4. City shall use the Trust Funds as follpws solely for the purpose of establishing <br />and maintaining a tree garden in Afton Baker Park to be known as the "Hays Memorial <br />Tree Garden."
