~i~yl~D~r <br />Ag~~~ment N~. ~4~~ <br />Regardless of who acquires ar perl~orrs any of the right of way activities, a right of <br />way services agreement shall be created by State" Region Technical tenter Right of <br />way office setting forkh the responsibilities and activities to be accor~plished by each <br />party. ~n any praject that has the potential of needing additional right of way, to <br />assure compliance in the event that additional right of way is unexpectedly needed, a <br />right of vuay services agreement will be required, State shall always be responsible <br />far requesting the obligation of project funding from FHVIIA, State, at praject expense, <br />shall be responsible far coordinating certification of the right of way, and providing <br />oversight and monitoring Funding authorizatian requests for federal right of way <br />funds must be sent through State's Regianal Laval Agency Liaisan, wha will forward <br />the request to State's Regian Technical tenter Right of 1111ay affice on all pro}ects. <br />The pity must receive authorisation to proceed from State's Right of v11ay Section <br />prior to beginning right of way activities. All projects must have right of way <br />certificatian coordinated through State's Region Technical tenter Right of vvay office <br />to declare compliance and praject readiness for construction seven for projects where <br />no federal funds were used far right of way} but federal funds were used elsewhere an <br />the praject}. pity shauld contact State's Regional Laval Agency Liaison f ha will <br />contact State's Region Technical tenter Right of way office for additional infarrnatian <br />ar clarification on behalf of pity. <br />4F pity agrees that if any real property purchased with federal~aid participation i na <br />longer needed for the originally authorised purpose, the disposition of such property <br />shall be subject to applicable rules and regulations, which are in effect at the time of <br />dispasitian.
