ADMINISTRATIVE ORDER NO. 58-08-09 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF THE <br />METROPOLITAN WASTEWATER MANAGEMENT COMMISSION <br />FEES IN THE WASTEWATER USER FEE SC~IEDULE AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 58-08-OS-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 6.411 of the Eugene, Code, 1971, authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for wastewater service, regional <br />wastewater service, and stormwater service. Pursuant to that authority, on May 2, 2008, I issued <br />Administrative Order No. 58-08-OS-F amending the Wastewater User Fee Schedule, which <br />became effective and final on May 13, 2008, for bills issued on or after July 1, 2008. <br />B. In accordance with subsection (1) of Section 6.411 of the Eugene Code, 1971, I <br />have conducted an investigation of the revenue needs of the City in providing wastewater <br />services and propose to amend the Wastewater User Fee Schedule by increasing Metropolitan <br />Wastewater Management Comrnission (MWMC) charges. The fee increases are based on the <br />following standards described in subsection (2) of Section 6.411 of the Eugene Code, 1971: (b) <br />the recommendation of the MWMC; (c) applicable federal or state regulations; (e) the revenue <br />needs for costs related to local and regional sewerage facilities; and (h) the terms of the <br />intergovernmental agreement relating to wastewater services. The following standards have not <br />been considered: (a) the amount charged for the services in the past; (d) amounts charged by the <br />City of Springfield and other such service providers for comparable services; ( fl special <br />surcharge rates for stormwater customer discharging stormwater at extraordinary expense to the <br />City; (g) other relevant adopted policies of the council; and (i) obtaining equity between different <br />classes of ratepayers. These standards are not applicable because only MWMC fees are being <br />amended, and the intergovernmental agreement between the parties provides that the City <br />"shall... adopt sewer user charges .:. and impose those charges on behalf of the Commission at <br />the rates and in the amounts recommended by the Commission..." I considered "amounts <br />charged by the City of Springfield" to the extent that it, too, is a party to the Intergovernmental <br />Agreement requiring both cities to adopt MWMC's recommended fees. In addition, standard (~ <br />does not apply to wastewater fees. <br />C. Based on my investigation and MWMC's recommendation, I propose to amend <br />the regional wastewater charges as set forth in the Notice of Intended Amendment of Wastewater <br />User Fee Schedule attached as Exhibit A.
