AgencylOD~T <br />Agreement No. 24689 <br />funds at the maximum allowable federal participating amount with Agency providing <br />the match and any non-participating costs, including all costs in excess of the <br />available federal funds. Agency shall retain the match for project and make all <br />payments to the project at 100 percent. State will reimburse Agency for the federal <br />portion. The cost between the total expenditure and the federal reimbursement will <br />constitute the Agency's match. State's estimated cost for work, done by the State, is <br />$10,000. State's Regional Local Agency Liaison shall send monthly expenditure <br />account SEA} invoices to Agency's Project Manager. Agency understands that State's <br />costs are estimates only and agrees to reimburse State for the actual amount <br />expended. <br />3. Agency shall select consultants, design, advertise, bid, award the construction <br />contract, and perform construction contract administration. Agency understands that <br />this Project is a test project and agrees to comply with all of the terms and conditions <br />found in Certification Program Agreement No. 24651. <br />4. The federal funding for this Project is contingent upon approval by the Federal <br />Highway Administration ~FHWA}. Any work performed prior to acceptance by FHVIJA <br />will be considered nonparticipating and paid for at Agency expense. The Catalog of <br />Federal Domestic Assistance ~CFDA}number for this Project is 24.205. <br />5. State considers Agency asub-recipient ofthe federal funds underthis Agreement. <br />6. State and Agency grant each ofiher authority to enter onto the other's right of way for <br />the performance of this Project. <br />7. Agency shall, upon completion of the Project, maintain the roadway at its own <br />expense. <br />S. The term of this Agreement shall begin on the date all required signatures are <br />obtained and shall terminate upon completion of the Project and final payment or ten <br />X10} calendar years following the date all required signatures are obtained, whichever <br />is sooner. <br />9. Local Agency Certification Program Agreement No. 24651 must be fully executed <br />before anyworkcan begin on this Project. <br />10. This Agreement shall supersede and replace Agreement No. 24516 and its <br />supplements in its entirety. Agreement No. 24516 will be terminated upon execution <br />of this Agreement. Invoices for preliminary engineering work incurred prior to the <br />replacement of Agreement No. 24516 can be invoiced by Agency and paid for by <br />State under this Agreement. <br />11.
